Sous couvert de \u00ab s\u00e9curit\u00e9 \u00e9conomique \u00bb et \u00ab d&rsquo;atteintes aux int\u00e9r\u00eats vitaux \u00bb du pays, la Tunisie s&rsquo;appr\u00eate \u00e0 adopter une loi qui fait fr\u00e9mir les d\u00e9mocrates.   Les organisations non gouvernementales et l&rsquo;opposition tunisienne critiquent ce texte adopt\u00e9e mardi 15 juin par la chambre de d\u00e9put\u00e9s en lui reprochant de criminaliser les critiques port\u00e9es \u00e0 l&rsquo;encontre du gouvernement.   Les Tunisiens n&rsquo;auront plus le droit d\u00e9sormais de nouer des contacts, \u00ab de mani\u00e8re directe ou indirecte \u00bb, avec des \u00ab agents d&rsquo;une puissance \u00e9trang\u00e8re ou d&rsquo;une institution ou organisation \u00e9trang\u00e8re\u00a0\u00bb si ces derniers portent pr\u00e9judice \u00ab aux int\u00e9r\u00eats vitaux de la Tunisie \u00bb.  Ce texte extr\u00eamement vague pourrait conduire devant les tribunaux les militants tunisiens des droits de l&rsquo;homme qui correspondent avec des ONG ou des m\u00e9dias \u00e9trangers.   Rappelons que l&rsquo;Union Europ\u00e9enne met en balance la d\u00e9mocratisation de la Tunisie en \u00e9change de la signature d&rsquo;un accord de partenariat avanc\u00e9. D&rsquo;un point de vue strictement \u00e9conomique, les d\u00e9nonciations de tortures et autres agissements antid\u00e9mocratiques nuisent bien au int\u00e9r\u00eats vitaux de la Tunisie. Le ministre tunisien de la justice et des droits de l&rsquo;homme Lazhar Bououni, a expliqu\u00e9 que \u00ab les crimes vis\u00e9s concernent notamment l&rsquo;incitation de parties \u00e9trang\u00e8res \u00e0 ne pas accorder de cr\u00e9dits \u00e0 la Tunisie, \u00e0 ne pas investir dans le pays et \u00e0 boycotter le tourisme \u00bb. Le Parlement tunisien a adopt\u00e9 mardi une loi controvers\u00e9e portant amendement de l&rsquo;article 61bis du code p\u00e9nal pour r\u00e9primer les actes jug\u00e9s contraires aux int\u00e9r\u00eats \u00e9conomiques du pays \u00e0 l&rsquo;\u00e9tranger. \u00ab\u00a0La loi (&#8230;) ne concerne ni la libert\u00e9 d&rsquo;opinion et d&rsquo;expression ni la criminalisation de la d\u00e9fense des droits de l&rsquo;homme\u00a0\u00bb, a assur\u00e9 le minist\u00e8re tunisien de la Justice et des droits de l&rsquo;homme dans un communiqu\u00e9. Elle \u00ab\u00a0incrimine l&rsquo;\u00e9tablissement de contacts avec des agents d&rsquo;un Etat \u00e9tranger, d&rsquo;institutions ou d&rsquo;organisations \u00e9trang\u00e8res dans le but de les inciter \u00e0 porter atteinte aux int\u00e9r\u00eats vitaux de la Tunisie relatifs \u00e0 sa s\u00e9curit\u00e9 \u00e9conomique\u00a0\u00bb, a-t-il ajout\u00e9. Pour Amnesty international, cette loi renforce les restrictions auxquelles font face les militants des droits de l&rsquo;homme en visant ceux qui s&rsquo;expriment sur la situation tunisienne dans des instances internationales. Cette nouvelle l\u00e9gislation appara\u00eet comme \u00ab\u00a0une r\u00e9ponse directe aux r\u00e9unions tenues en mai dernier par des d\u00e9fenseurs tunisiens de droits de l&rsquo;homme avec des parlementaires et responsables europ\u00e9ens \u00e0 Madrid et Bruxelles\u00a0\u00bb, avait estim\u00e9 l&rsquo;organisation dans un communiqu\u00e9 \u00e0 Londres. The legislation comes at a time when Tunisia&rsquo;s application to the EU for \u00ab\u00a0advanced status\u00a0\u00bb, which would give it preferential trade terms, could be complicated by opposition allegations about the government&rsquo;s human rights record. Justice and Human Rights Minister Lazhar Bououni said the amendments to the penal code, adopted by parliament on Tuesday, were in line with legislation in other countries and were needed to protect citizens. \u00ab\u00a0The country&rsquo;s vital interests are anything that has to do with its economic security,\u00a0\u00bb the minister said. He denied that the legislation in any way limited freedom of expression. Examples of crimes under the new law included \u00ab\u00a0inciting foreign parties not to give a loan to Tunisia, or to not invest in the country, as well as incitement to boycott tourism and obstructing Tunisia&rsquo;s efforts to obtain advanced partner status with the EU\u00a0\u00bb, Bououni said. President Zine al-Abidine Ben Ali says he is committed to democracy and free speech. Opposition parties and human rights organisations say the Tunisian authorities suppress dissent and harass their opponents, allegations the government denies. Human rights campaigner and Ben Ali opponent Mohamed Abbou said the law could be used to imprison anti-government activists who sought help from foreigners. Lawyer Samir Ben Amor said anyone found guilty of the offences set out in the law could get between five and 12 years in prison. &#8211; \u00a0<\/div>\n<p><\/font><\/div>\n<p><strong><\/p>\n<div>\n<hr\/>\n<\/div>\n<div align=\"center\"><font><b><span>Tunisia\u2019s New Law May Strangle Unalienable Rights<\/span><\/b><\/font><\/div>\n<div>\n<hr\/>\n<\/div>\n<p><\/strong><\/font><\/font><\/span><\/p>\n<p><b><span>By <\/span><span><a target=\"_blank\" title=\"Posts by Gordon Aldridge\" rel=\"noopener\"><span>Gordon Aldridge<\/span><\/a><\/span><\/b><\/p>\n<p><b><span>Published: June 19, 2010<\/span><\/b><\/p>\n<p><span>There were responses of doubt and anger from many people in both Tunisia and the international community regarding the Tunisian government\u2019s adoption of a new law that may restrict freedom of speech and press..even more than it is.<\/span><\/p>\n<p><span>Under the leadership of Tunisia\u2019s President Zine El Abidine Ben Ali, who\u2019s been winning the elections since 1987, \u00a0the <\/span><i><span>Majlis al-Nuwaab<\/span><\/i><span> or \u2018The Chamber of Deputies\u2019 voted to pass this law after the Chamber of Councillors which states any Tunisian to<\/span><i><span> \u201ccontact agents of a foreign state\u201d<\/span><\/i><span> with the intention of harming <\/span><i><span>\u201cTunisia\u2019s vital interests\u201d<\/span><\/i><span> will be persecuted by the government for \u2018treason\u2019.<\/span><\/p>\n<p><span>Defending its decision, the Tunisian government argued that the law will protect Tunisia\u2019s economy which has seen a positive growth. The government has also taken pains to participate more in the global market by closely observing the euro and creating a national commission to hammer out measures which should protect Tunisia\u2019s economy from the current financial environment of the world.<\/span><\/p>\n<p><span>Yet, human rights groups and activists warily see this new law as the government\u2019s latest attempt to suppress human rights. According to the Canadian Press,<\/span><i><span> \u201cfive leading internationals rights groups Thursday said the law will allow an increase of harassment against Tunisians\u201d<\/span><\/i><span>.<\/span><\/p>\n<p><span>Going against what a law should be, specifically specific, the law is very vague which should allow the government a lot of room to exercise their power to \u201cprotect\u201d its <\/span><i><span>\u201cinterests\u201d. <\/span><\/i><\/p>\n<p><span>Human rights groups have a reason to be worried by this legal move as cases of torture and death alongside <\/span><i><span>\u201cdissapearences\u201d <\/span><\/i><span>has been piling up in recent years.<\/span><\/p>\n<p><span>Of course, like other certain governments the Tunisian government denied all this and said that the law will <\/span><b><i><span>only<\/span><\/i><\/b><span> be used to protect the economy.<\/span><\/p>\n<p><span>Tunisia, ever since President Ben Ali took power in the 1980\u2019s, has seen a bulky increase in police forces with a gradual, strangling hold on certain unalienable rights of the Tunisian people. The government\u2019s efficiency in battling corruption and such is at best questionable. Its history of arresting political opponents, controlling the media including the Internet, sanctioning violence, and imprisoning journalists have grown throughout the years.<\/span><\/p>\n<p><span>Strangely enough, freedom of speech and press is actually guaranteed in the Tunisian constitution, but that seems to have been ignored for the time being.<\/span><\/p>\n<p><span>The government is aware of this which explains the President\u2019s previous law that prevents him from being legally prosecuted in the event he no longer holds the presidency.<\/span><\/p>\n<p><span>The Committee to Protect Journalism criticized the Tunisian government for passing a bill<\/span><i><span>\u201cthat reinforces an existing arsenal of legislation used to silence critical journalists\u201d<\/span><\/i><span>.
