Des voix ind\u00e9pendantes r\u00e9duites au silence<\/em><\/a>, ce document relate le combat quotidien auquel sont en butte les Tunisiens qui osent critiquer les autorit\u00e9s et sont, notamment, confront\u00e9s \u00e0 l&rsquo;infiltration des organisations de d\u00e9fense des droits humains et au harc\u00e8lement des militants.   \u00ab\u00a0La d\u00e9stabilisation des organisations de d\u00e9fense des droits humains orchestr\u00e9e par les autorit\u00e9s tunisiennes et les nombreuses prises de pouvoir men\u00e9es par les partisans du gouvernement au sein d&rsquo;organisations ind\u00e9pendantes composent une politique que nous ne pouvons nous permettre d&rsquo;ignorer, a d\u00e9clar\u00e9 Hassiba Hadj Sahraoui, directrice adjointe du programme Moyen-Orient et Afrique du Nord d&rsquo;Amnesty International. Cette cynique strat\u00e9gie des autorit\u00e9s tunisiennes doit \u00eatre condamn\u00e9e avec fermet\u00e9.\u00a0\u00bb  La Ligue tunisienne des droits de l&rsquo;homme est confront\u00e9e \u00e0 une pression interne incessante depuis qu&rsquo;elle a \u00e9t\u00e9 l\u00e9galement contrainte d&rsquo;ouvrir ses portes \u00e0 tout le monde en 1992, permettant ainsi aux partisans du gouvernement d&rsquo;y adh\u00e9rer et d&rsquo;\u00e9branler son travail essentiel en faveur des droits fondamentaux.  Des litiges juridiques ont \u00e9clat\u00e9 entre le conseil ex\u00e9cutif et des membres proches des autorit\u00e9s et le parti au pouvoir sur des questions comme la fermeture de bureaux r\u00e9gionaux, d\u00e9bouchant sur une impasse et la suspension effective des activit\u00e9s de la Ligue.  Autre exemple, l&rsquo;Association des Magistrates Tunisiens (AMT) est d\u00e9sormais contr\u00f4l\u00e9e par des partisans du gouvernement, qui en ont pris les r\u00eanes apr\u00e8s que l&rsquo;association a d\u00fb faire face \u00e0 plusieurs accrochages avec les autorit\u00e9s concernant l&rsquo;ind\u00e9pendance judiciaire.  En ao\u00fbt 2009, la direction ind\u00e9pendante du Syndicat national des journalistes tunisiens (SNJT) a \u00e9t\u00e9 renvers\u00e9e par des partisans du gouvernement parce qu&rsquo;elle avait refus\u00e9 d&rsquo;appuyer la candidature du pr\u00e9sident Ben Ali \u00e0 l&rsquo;approche des \u00e9lections pr\u00e9sidentielle et l\u00e9gislatives d&rsquo;octobre 2009.  Le nouveau comit\u00e9, \u00e9lu lors d&rsquo;un congr\u00e8s extraordinaire, s&rsquo;est empress\u00e9 de donner son aval \u00e0 la candidature du pr\u00e9sident tunisien.  \u00ab\u00a0Cette strat\u00e9gie du sabotage semble \u00eatre cautionn\u00e9e par les plus hautes sph\u00e8res en Tunisie. Les d\u00e9fenseurs des droits humains et les dissidents sont accus\u00e9s de ne pas \u00eatre de vrais patriotes et de renoncer \u00e0 l&rsquo;honneur d&rsquo;appartenir \u00e0 la nation tunisienne, avant d&rsquo;\u00eatre soumis \u00e0 des mesures de harc\u00e8lement et d&rsquo;intimidation\u00a0\u00bb, a expliqu\u00e9 Hassiba Hadj Sahraoui.  En outre, les autorit\u00e9s tunisiennes ont bloqu\u00e9 l&rsquo;enregistrement officiel des organisations de d\u00e9fense des droits humains et de l&rsquo;opposition, leur imposant une situation de vide juridique pendant de longues p\u00e9riodes, ce qui les place dans l&rsquo;incapacit\u00e9 de se r\u00e9unir ou d&rsquo;agir l\u00e9galement en vertu de la loi tunisienne.  Le Code p\u00e9nal tunisien a \u00e9t\u00e9 modifi\u00e9 en juin 2010 afin d&rsquo;\u00e9touffer les critiques \u00e9manant de l&rsquo;\u00e9tranger quant au bilan de la Tunisie en termes de droits humains\u00a0: il \u00e9rige en infractions les actes de ceux qui contactent des organismes \u00e9trangers affichant des objectifs consid\u00e9r\u00e9s comme portant atteinte \u00e0 la \u00ab\u00a0s\u00e9curit\u00e9 \u00e9conomique\u00a0\u00bb du pays.  Cette mesure a \u00e9t\u00e9 per\u00e7ue comme une tentative de r\u00e9primer les militants tunisiens qui s&rsquo;efforcent de porter le bilan de la Tunisie en termes de droits humains \u00e0 l&rsquo;attention des partenaires internationaux qui envisagent des \u00e9changes commerciaux.  \u00ab\u00a0Comptant sur le silence honteux de leurs partenaires internationaux, les autorit\u00e9s tunisiennes visent maintenant \u00e0 r\u00e9duire au silence les critiques \u00e9manant de l&rsquo;\u00e9tranger\u00a0\u00bb, a d\u00e9plor\u00e9 Hassiba Hadj Sahraoui.  Le harc\u00e8lement des militants des droits humains se poursuit \u00e9galement en Tunisie, les plaintes ne faisant gu\u00e8re l&rsquo;objet d&rsquo;investigations.  Les d\u00e9fenseurs des droits humains sont surveill\u00e9s chez eux et au travail par des membres des forces de s\u00e9curit\u00e9, qui vont jusqu&rsquo;\u00e0 les suivre \u00e0 leurs rendez-vous chez le m\u00e9decin ou m\u00eame \u00e0 des fun\u00e9railles. Amnesty International a recens\u00e9 une longue liste d&rsquo;agissements, allant des coups et blessures aux poursuites engag\u00e9es contre des militants sur la base d&rsquo;accusations forg\u00e9es de toutes pi\u00e8ces.  Ali Ben Salem, 78\u00a0ans, fait constamment l&rsquo;objet de man\u0153uvres de harc\u00e8lement et d&rsquo;intimidation de la part des autorit\u00e9s tunisiennes, parce qu&rsquo;il d\u00e9nonce depuis longtemps le bilan de son pays en mati\u00e8re de droits humains. Membre fondateur de l&rsquo;Association de lutte contre la torture en Tunisie et du Conseil national pour les libert\u00e9s en Tunisie, il a d\u00e9pos\u00e9 une plainte contre les autorit\u00e9s tunisiennes aupr\u00e8s des Nations unies en novembre 2007 et a obtenu gain de cause.  Son \u00e9tat de sant\u00e9 est pr\u00e9occupant. Il souffre de troubles cardiaques et des cons\u00e9quences des actes de torture qui lui ont \u00e9t\u00e9 inflig\u00e9s en 2000, lorsqu&rsquo;il a \u00e9t\u00e9 arr\u00eat\u00e9, rou\u00e9 de coups, asperg\u00e9 de gaz lacrymog\u00e8ne et laiss\u00e9 pour mort sur un site de construction pr\u00e8s de Tunis.  Il n&rsquo;est plus en mesure de prendre en charge ses soins m\u00e9dicaux, les autorit\u00e9s ayant bloqu\u00e9 sa retraite de la fonction publique.  Le gouvernement tunisien a r\u00e9cemment sollicit\u00e9 les services d&rsquo;une agence am\u00e9ricaine de relations publiques et a lanc\u00e9 une campagne de relations publiques visant \u00e0 contrer son image de tortionnaire et \u00e0 pr\u00e9senter le pays comme s\u00fbr pour les investissements \u00e9trangers.  \u00ab\u00a0Au lieu de consacrer tant de temps, d&rsquo;argent et d&rsquo;efforts \u00e0 redorer leur image, les autorit\u00e9s tunisiennes devraient employer leurs ressources \u00e0 rem\u00e9dier efficacement aux nombreuses violations des droits humains commises dans le pays, a conclu Hassiba Hadj Sahraoui. Les partenaires internationaux de la Tunisie doivent prendre conscience du fait que l&rsquo;espace qui est allou\u00e9 aux droits humains se r\u00e9tr\u00e9cit rapidement.\u00a0\u00bb<\/p>\n<p><\/font><\/p>\n<div>\n<hr\/>\n<\/div>\n<div align=\"center\"><font face=\"Arial\" size=\"2\">\u00a0 <\/p>\n<h2 style=\"color: red;\"><font size=\"3\"><strong><font size=\"2\">Amnesty International<\/font> Tunisia urged to end subversion of groups critical of the authorities<\/strong><\/font><\/h2>\n<p><\/font><\/div>\n<p><font face=\"Arial\" size=\"2\"><\/p>\n<div>\n<hr\/>\n<\/div>\n<div> \u00a0<\/div>\n<h2 align=\"left\" class=\"ecxpane-title\" style=\"color: red;\"><font size=\"2\">13 July 2010<\/font><\/h2>\n<p align=\"justify\">The Tunisian authorities should end their subversion of human rights organizations and dissenting groups by infiltrating them and provoking turmoil, Amnesty International has said in a new report.  <em>Independent Voices Stifled in Tunisia<\/em> documents the daily struggle faced by Tunisians who dare to criticize the authorities including the infiltration of human rights groups and the harassment of individual activists.\u00a0\u00a0   \u00a0\u201cThe disruption of human rights organisations by the Tunisian authorities and the fact that so many independent organizations have now fallen victim to coups staged by government supporters is a pattern that we cannot afford to ignore.\u201d said Hassiba Hadj Sahraoui, Deputy Director at Amnesty International\u2019s Middle East and North Africa programme. \u201cThis cynical manoeuvring by the Tunisian authorities should be roundly condemned.\u201d   The Tunisian League for Human Rights has faced continued internal pressure since it was legally forced to open up its membership to anyone in 1992, allowing government supporters to join and undermine the organization\u2019s vital human rights work.\u00a0\u00a0   Legal disputes between the membership close to the authorities and the ruling party and the executive board over issues including the closing of regional offices broke out, leading to stalemate and an effective suspension of the League\u2019s activities.\u00a0\u00a0   In another example, the Association of Tunisian Judges (Association des Magistrates Tunisiens, AMT) is now effectively run by government supporters following its takeover by them having experiencing a number of run-ins with the authorities over judicial independence.  In August 2009, the independent leadership of the National Syndicate of Tunisian Journalists (Syndicat national des journalistes tunisiens, SNJT) was toppled by government supporters after refusing to endorse the candidacy of President Ben \u2018Ali in run-up to the October 2009 presidential and legislative elections.   A new board was elected by special congress and wasted no time in endorsing the candidacy of the Tunisian president.   \u201cThese sabotage tactics appear to be sanctioned at the highest levels in Tunisia.\u00a0 Human rights activists and those who dissent are accused of being unpatriotic and relinquishing the honour of belonging to Tunisia, before being harassed and intimidated\u201d said Hassiba Hadj Sahraoui.   The Tunisian authorities have also blocked official registration of opposition and human rights organizations, leaving them in legal limbo for long periods unable to meet or operate legally under Tunisian law.   The country\u2019s Penal Code was amended in June 2010, to stifle criticism of Tunisia\u2019s human rights record from abroad by criminalizing the actions of people who contact foreign bodies pursuing objectives that are considered harmful to Tunisia\u2019s \u2018economic security\u2019.   This move was seen as an attempt to quash Tunisian activists working to bring Tunisia\u2019s human rights record to the attention of international partners when considering trade relations.   \u201cRelying on the shameful silence of their international partners, the Tunisian authorities are now aiming at silencing criticism abroad as well\u201d, said Hassiba Hadj Sahraoui   The harassment of individual human rights activists in Tunisia also continues with little or no investigation of complaints.   Human rights activists are monitored by security officers at home and at work, followed to doctor\u2019s appointments and even to funerals.\u00a0 Amnesty International has documented a catalogue of incidents ranging from physical assault to prosecution of activists based on trumped-up charges.   Ali Ben Salem, 78, has been continually harassed and intimidated by the Tunisian authorities because he is a long-standing critic of Tunisia\u2019s human rights record.\u00a0 He is a founding member of both the Association for the Fight against Torture in Tunisia (Association de lutte contre la torture en Tunisie) and the National Council for Liberties in Tunisia (Conseil national pour les libert\u00e9s en Tunisie), and successfully lodged a complaint against the Tunisian authorities before the UN in November 2007.   He is in poor health, with heart problems and continues to suffer the effects of the torture he endured in 2000, when he was arrested, beaten, sprayed with tear gas and left for dead at a construction site near Tunis.\u00a0\u00a0   He is now unable to pay for medical treatment as the authorities have blocked his civil service pension. Tunisia is in the process of applying to the European Union for \u00ab\u00a0advanced status,\u00a0\u00bb which could give it preferential trade terms, but diplomats say concerns in some EU capitals about its rights record could complicate the application. Tunisia&rsquo;s government says it is committed to democracy and human rights. It denies repressing dissent and says that in some cases it is forced to act against people who break the law and undermine the country&rsquo;s reputation. In a report entitled \u00ab\u00a0Independent voices stifled in Tunisia,\u00a0\u00bb Amnesty said many independent civil society groups had found themselves being taken over by government loyalists to mute any criticism. The group also said rights campaigners and other activists were routinely followed by police, lawyers who defend rights cases can be prevented from practising and groups were often barred from renting meeting rooms. \u00ab\u00a0Human rights activists and those who dissent are accused of being unpatriotic and relinquishing the honour of belonging to Tunisia, before being harassed and intimidated,\u00a0\u00bb Amnesty&rsquo;s Hassiba Hadj Sahraoui said in a statement. Tunisia is a country of about 10 million people whose economy &#8212; based mainly on tourism, farming and manufacturing &#8212; depends on close ties to Europe. President Zine al-Abidine Ben Ali has led the country for more than two decades. Many Tunisians credit him with overseeing stability and relative prosperity in a region where civil strife and poverty are common. Photograph: Str\/AP <\/p>\n<p><a target=\"_blank\" title=\"More from guardian.co.uk on Tunisia\" rel=\"noopener\">Tunisia<\/a> has been taken to task for subverting civil society and professional organisations which criticise the authorities in one of the most modern but repressive countries in the Arab world.<\/p>\n<p><a target=\"_blank\" title=\"Amnesty International\" rel=\"noopener\">Amnesty International<\/a> said in a report yesterday that the government of President Zine al-Abidine Ben Ali routinely infiltrates or takes over<a target=\"_blank\" title=\"More from guardian.co.uk on Human rights\" rel=\"noopener\">human rights<\/a> and other independent groups to effectively control them and silence dissent.<\/p>\n<p>The penal code was also amended last month to stifle criticism of the country&rsquo;s human rights record from abroad by criminalising the actions of citizens who contact foreign organisations pursuing objectives that are considered harmful to Tunisia&rsquo;s \u00ab\u00a0economic security\u00a0\u00bb. The North African country of 10 million people is a favourite destination for European holidaymakers and is widely perceived as a haven of stability and secularism in a turbulent region plagued by Islamists. EU governments, especially the still-influential former colonial power France, are often accused of ignoring abuses in the pursuit of business and security interests. Amnesty says: \u00ab\u00a0The reality in Tunisia is that political and economic life is under tight government control and only the official discourse of praise of the authorities is tolerated. The government uses aggressive and repressive tactics to extend that control to the few remaining pockets of independent expression.\u00a0\u00bb The report describes how, last August, the independent leadership of the National Syndicate of Tunisian Journalists was overrun by government supporters after refusing to endorse the candidacy of Ben Ali in presidential and legislative elections. A new board was elected, and endorsed the president&rsquo;s candidacy. He went on to win 89% of the vote. It also cites the example of the Tunisian League for Human Rights, which has been paralysed by disputes apparently instigated by new members close to the ruling party. The Association of Tunisian Judges is now effectively run by government supporters who took it over. Amnesty&rsquo;s Middle East and North Africa deputy director, Hassiba Hadj Sahraoui, said:\u00a0\u00bbThe disruption of human rights organisations by the Tunisian authorities and the fact that so many independent organisations have now fallen victim to coups staged by government supporters is a pattern that we cannot afford to ignore. These sabotage tactics appear to be sanctioned at the highest levels.\u00a0\u00bb State media outlets often smear human rights activists, especially women, who are described as lesbians or \u00ab\u00a0acting like prostitutes\u00a0\u00bb. Many are monitored by security officers at home and work, followed to doctor&rsquo;s appointments and even to funerals, and accused of being paid agents of the US and Israel. Ali Ben Salem, 78, is subject to continuous intimidation because he is a veteran critic of Tunisia&rsquo;s human rights record. In poor health, he has heart problems and continues to suffer the effects of the torture he endured in 2000 when he was arrested, beaten, sprayed with tear gas and left for dead. He is unable to pay for medical treatment as the authorities have blocked his civil service pension. In a report to be issued on Tuesday Amnesty says that \u201canyone who is critical of the Tunisian authorities or who speaks out for human rights in Tunisia is at risk\u201d. \u00a0<\/p>\n<div>\n<div>\n<div><\/div>\n<p><font size=\"2\">Amnesty cites a law adopted last month that in effect criminalises any action aimed at mobilising foreign pressure on Tunisia to improve its human rights record.<\/font><\/div>\n<\/div>\n<p>The law opens to punishment any Tunisian who contacts foreign parties with the aim of harming the country\u2019s \u201ceconomic security\u201d. It seems aimed particularly at local human rights activists who lobby for more pressure on their government from the European Union, Tunisia\u2019s foremost trade and investment partner. In its report Amnesty also mentions what it describes as the infiltration of independent civil society organisations by government supporters with the aim of creating dissension and disrupting their work. It says this tactic has been used to undermine independent organisations representing judges, journalists and students as well as the Tunisian League for Human Rights. The league has been mired in internal struggles and court cases for almost 10 years after it was forced to admit government supporters within its ranks. Amnesty also lists a catalogue of punitive actions by the authorities against human rights defenders and independent journalists which include harassment of their families, beatings, monitoring by security agents, confiscations of passports and imprisonment on trumped up charges. \u201cHuman rights activists are monitored by security officers at home and at work, followed to doctors\u2019 appointments and even to funerals,\u201d says Amnesty. The group highlights the case of Ali Ben Salem, a 78-year-old human rights activist whose public denouncements of torture are said to have caused the authorities to cut off his pension and left him unable to meet medical costs. According to Amnesty, he is constantly watched in his home in the town of Bizerte by security agents and has been assaulted several times. Only family and close friends are allowed to visit him and he is followed everywhere. He has been denied a passport since 1995 and his phone line and internet access have been cut since 2005. The Tunisian authorities deny that they target human rights defenders.
