It is inconceivable that free and fair elections can take place in an environment in which independent media are harassed and silenced. We urge you to honor your oft-stated commitment to promote free expression, and we ask that you instruct your government to allow our colleagues to perform their work unhindered.<\/p>\n<p align=\"justify\">We are increasingly concerned that acts of reprisal against critical journalists continue without respite while your government repeats its unsubstantiated<a href=\"http:\/\/cpj.org\/blog\/Tunisia.embassy.11.10.08.pdf\" target=\"_blank\" rel=\"noopener\">claim<\/a> that the Tunisian media landscape is \u00ab\u00a0liberal and pluralistic.\u00a0\u00bb Indeed, it remains far from being liberal or pluralistic, as U.S. Sen. John Kerry noted at the July 7 confirmation hearing of Ambassador Gordon Gray by the Senate Committee on Foreign Relations. Kerry remarked that Tunisia \u00ab\u00a0lags far behind even some of its neighbors in respect for human rights.\u00a0\u00bb <\/p>\n<p align=\"justify\">CPJ research shows that no progress has been made toward ending drastic restrictions on independent journalism and halting harassment and intimidation of critical journalists and their families since our 2008 report, \u00ab\u00a0<a href=\"http:\/\/cpj.org\/reports\/2008\/09\/tunisia-oppression.php\" target=\"_blank\" rel=\"noopener\">The Smiling Oppressor<\/a>.\u00a0\u00bb In April, CPJ cited Tunisia as one of the<a href=\"http:\/\/www.cpj.org\/reports\/2009\/04\/10-worst-countries-to-be-a-blogger.php\" target=\"_blank\" rel=\"noopener\">worst countries<\/a> in the world in respecting online expression.<\/p>\n<p align=\"justify\">This poor freedom of expression record is all the more disheartening because Tunisia was among the first countries in the region to sign and ratify the International Covenant on Civil and Political Rights, doing so without reservations. The constitution adopted in June 1959 unequivocally guarantees free press and free expression.<\/p>\n<p align=\"justify\">Unfortunately, the gap between your repeated pledges to uphold Tunisia&rsquo;s domestic law and international obligations, on the one hand, and the plight of Tunisian media, on the other, has widened over the years, according to local and international human rights groups. In addition to abuses<a href=\"http:\/\/cpj.org\/2009\/03\/cpj-presses-tunisia-on-poor-press-freedom-record.php\" target=\"_blank\" rel=\"noopener\">brought to you attention<\/a> by CPJ on the eve of the 53rd anniversary of Tunisia&rsquo;s independence from France, we would like to raise the following press freedom violations. <\/p>\n<p align=\"justify\"><span><span>\u2022 <\/span><span><\/span><\/span><b>Harassment of critical journalists and their families.<\/b> On July 2, unidentified individuals broke into a small grocery shop owned by Afaf Bennacer, wife of journalist Fahem Boukadous, on the outskirts of the southern city of Gafsa. In addition to taking goods and money, the intruders also destroyed merchandise and took a family photograph of no monetary value&#8211;actions that Bennacer said indicate their intention was harassment and intimidation.<\/p>\n<p align=\"justify\">Boukadous went into hiding on July 5, 2008, to escape government persecution stemming from his coverage of social unrest in the south of the country for the satellite television station Al-Hiwar Al-Tunisi. On February 4, an appeals court in Gafsa upheld his six-year prison sentence for allegedly \u00ab\u00a0belonging to a criminal association\u00a0\u00bb and spreading material \u00ab\u00a0likely to harm public order.\u00a0\u00bb Other Al-Hiwar Al-Tunisi correspondents, including Ayman Rezgui, have been harassed and briefly detained by police.<\/p>\n<p align=\"justify\">On June 5, the home of Hamadi Jebali, editor of the now-defunct weekly <i>Al-Fajr<\/i>, who was freed in 2006 after 15 years in prison, was surrounded by police without explanation, the local human rights group Huriyya wa Insaf reported. Jebali told CPJ that he and his wife remain under tight police surveillance and their right to freedom of movement outside their hometown of Sousse is severely restricted. Both applied for passports nearly eight months ago, but their applications remained unanswered. \u00ab\u00a0They seem determined to keep stifling me at a low pace. I cannot move freely or earn a living. But I don&rsquo;t understand why they are targeting my wife,\u00a0\u00bb he said. <\/p>\n<p align=\"justify\">Jebali was first jailed in 1991 for publishing an article calling for the abolition of military tribunals in Tunisia. He was tried by a military court in 1992, along with 279 others accused of belonging to Al-Nahda, a banned Islamist group, and was sentenced to 16 years in prison. International human rights groups monitoring the mass trial concluded that the proceedings fell far below international standards of justice.<\/p>\n<p align=\"justify\">The plight of<a href=\"http:\/\/cpj.org\/2007\/08\/tunisian-internet-editor-to-stand-trial.php\" target=\"_blank\" rel=\"noopener\">Abdallah Zouari<\/a>, a former <span>reporter for <i>Al-Fajr<\/i>,<\/span> remains unchanged: He has been forced to live under \u00ab\u00a0administrative control\u00a0\u00bb and strict police surveillance hundreds of miles from his family since his release from an 11-year prison term in 2002. This month, he told CPJ that he hoped he would be allowed to live with his wife and children in Tunis at the end of this cruel \u00ab\u00a0administrative control\u00a0\u00bb in early August. In March, he was detained for nearly five hours at a police station in the suburbs of the southern city of Zarzis. Zouari is not allowed to leave the village without police authorization.<\/p>\n<p align=\"justify\"><span><span>\u2022 <\/span><span>\u00a0\u00a0 \u00a0<\/span><\/span><b>Interference with the National Syndicate of Tunisian Journalists.<\/b> On May 4, a group of pro-government journalists<a href=\"http:\/\/cpj.org\/2009\/05\/tunisian-government-tries-to-oust-head-of-journali.php\" target=\"_blank\" rel=\"noopener\">prevented<\/a> Neji Bghouri, president of the National Syndicate of Tunisian Journalists, from speaking during a press conference in Tunis, amid threats and insults. Bghouri was releasing a report on anti-press attacks to mark World Press Freedom Day. This critical report and the independent line adopted by leading members of the democratically elected syndicate board, particularly their decision not to side with any presidential candidate in the October election, appear to be the main cause of a government-backed campaign of intimidation.<\/p>\n<p align=\"justify\">Journalists told CPJ that many reporters, fearful of losing their jobs, signed a petition backed by the Ministry of Communications that expressed no confidence in the syndicate&rsquo;s board and sought an extraordinary meeting to elect new members. State-controlled newspapers have echoed the position of pro-government journalists who announced that they would hold a meeting on August 15 to take control of the syndicate.<\/p>\n<p align=\"justify\"><span><span>\u2022 <\/span><span>\u00a0\u00a0 \u00a0<\/span><\/span><b>Bureaucratic obstruction targeting critical journalists.<\/b> Critical journalists must routinely wait many months for passports to be issued. In August 2008, CPJ<a href=\"http:\/\/cpj.org\/2008\/08\/tunisia-denies-passport-to-formerly-imprisoned-jou.php\" target=\"_blank\" rel=\"noopener\">wrote to you<\/a> to protest the government&rsquo;s refusal since 2003 to grant a passport to the writer Slim Boukhdhir. To date, no explanation has been given about this gross violation of Boukhdhir&rsquo;s rights; the right to freedom of movement inside and outside one&rsquo;s country is enshrined in the Tunisian Constitution and the International Covenant on Civil and Political Rights. Boukhdhir, a journalist who writes for several Arabic Web sites and newspapers, served nearly a year in prison on baseless charges of insulting a public employee, violating \u00ab\u00a0public decency,\u00a0\u00bb and refusing to hand over identification to police. His<a href=\"http:\/\/cpj.org\/2007\/11\/critical-writer-jailed-in-tunisia.php\" target=\"_blank\" rel=\"noopener\">arrest<\/a> in November 2007 occurred soon after he waged a hunger strike to protest the government&rsquo;s refusal to grant him a passport. <\/p>\n<p align=\"justify\">Rachid Khechana, editor of the opposition weekly <i>Al-Mawkif<\/i> and correspondent of the London-based daily <i>Al-Hayat<\/i>, told CPJ that he applied for a replacement of his lost passport on April 7, but was told by authorities that he might have to wait a year before getting a new one. The refusal to issue new passports to Khechana and his colleague at <i>Al-Mawkif<\/i>, Mohamed Hamrouni, is viewed by human rights lawyers as an unlawful response to critical writing. Hamrouni who is also correspondent to the Qatari daily <i>Al-Arab<\/i>, applied for a passport in May. Over the years, even critical Tunisian journalist living in exile have been kept waiting for months before having their passports renewed. <\/p>\n<p align=\"justify\">We urge you to take immediate and decisive action to end the harassment of independent journalists and to bring your government&rsquo;s practices in line with international standards for free expression.<\/p>\n<p align=\"justify\">Thank you for your attention to these pressing matters. Il leur a promis de changer le personnel dont les d\u00e9tenus se sont plaints. Il a promis d&rsquo;am\u00e9liorer les conditions d&rsquo;hygi\u00e8ne et de nourriture. C&rsquo;est donc une avanc\u00e9e substancielle que les gr\u00e9vistes ont fini par arracher, et qui a motiv\u00e9 leur d\u00e9cision de mettre fin \u00e0 leur mouvement de gr\u00e8ve de la faim.  N\u00e9anmoins, un autre chapitre non moins important de leurs revendications reste encore sans solution : Mr Mehmet Behzat Cambazoglu a refus\u00e9 de leur donner des engagements au sujet de leur sortie du Centre o\u00f9 la plupart sont d\u00e9tenus depuis plus d&rsquo;un an et sans motif d\u00e9clar\u00e9. C&rsquo;est donc une avanc\u00e9e toute relative qu&rsquo;on vient d&rsquo;enregistrer, mais qui nous motive pour redoubler nos efforts pour qu&rsquo;une solution soit trouv\u00e9e aux d\u00e9tenus du Gantanamo turc de Kirklareli. Nous en appelons \u00e0 la mobilisation d&rsquo;Amnesty International, de HRW, de l&rsquo;OMCT, de l&rsquo;ACAT afin de soulever au niveau politique europ\u00e9en et onusien le probl\u00e8me des Gantanamo europ\u00e9ens non seulement en Turquie mais aussi en Italie, en Espagne, en France et dans bien d&rsquo;autres pays europ\u00e9ens qui se revendiquent encore de l&rsquo;Etat de droit : il est urgent de d\u00e9manteler les Gantanamo et les pratiques d&rsquo;un autre \u00e2ge. Cette question se pose avec plus d\u2019insistance encore si le jugement en question n&rsquo;est qu\u2019un jugement de premier degr\u00e9 et que l&rsquo;affaire reste encore en examen devant les magistrats de second degr\u00e9 en vertu de l&rsquo;appel interjet\u00e9 par le d\u00e9fendeur. \u00a0 Il semble que ces consid\u00e9rations n&rsquo;ont pas venu \u00e0 l&rsquo;esprit des responsables du ministre de la justice qui se cachent derri\u00e8re le titre des \u00ab\u00a0autorit\u00e9s tunisiennes\u00a0\u00bb quand ils ont pris l&rsquo;initiative de d\u00e9fendre et de justifier le premier jugement prononc\u00e9 contre Mme Khedija Arfaoui telle que rapport\u00e9 par les agences de presse internationaux. Tel un enfant ali\u00e9n\u00e9 notre justice \u00e0 besoin d\u2019un pouvoir tuteur qui vient chaque fois la d\u00e9fendre et l\u2019orienter semble nous dire cette interf\u00e9rence dans ce proc\u00e8s.  Si la condamnation de Mme Khedija Arfaoui \u00ab\u00a0est tout \u00e0 fait fond\u00e9e sur le plan juridique. La loi p\u00e9nale tunisienne sanctionne la divulgation de fausses nouvelles de nature \u00e0 troubler l&rsquo;ordre public\u201d, comme le dit le communiqu\u00e9 officiel rapport\u00e9, n&rsquo;aurait-il pas \u00e9t\u00e9 plus ad\u00e9quat et en m\u00eame temps conforme \u00e0 la loi et au fonctionnement de nos institutions de laisser le minist\u00e8re public d\u00e9tailler cet argument devant les magistrats saisi de l&rsquo;affaire au lieu de transporter pr\u00e9matur\u00e9ment le proc\u00e8s sur les m\u00e9dias ?  Par cette prise de position officielle et publique le gouvernement enfreint \u00e0 son obligation de neutralit\u00e9 dans sa fonction de veiller \u00e0 l\u2019application de la loi. Les autorit\u00e9s se positionnent ainsi en adversaire d\u00e9clar\u00e9 \u00e0 une simple citoyenne qui ne demandait qu\u2019a \u00eatre \u00e9quitablement jug\u00e9. Une telle prise de position officielle ne peut \u00eatre interpr\u00e9t\u00e9e qu\u2019en tant que directives adress\u00e9s directement aux juges saisis de l&rsquo;affaire ou du moins comme une flagrante intimidation dans l&rsquo;intention d\u2019orienter leur d\u00e9cision dans le sens qu\u2019ils ont explicitement formul\u00e9 dans leur d\u00e9claration.  Cette \u00e9pisode, qui n\u2019est malheureusement pas isol\u00e9, soit pour accabler un justiciable ou pour lui assurer l\u2019impunit\u00e9, n&rsquo;est qu&rsquo;une illustration de plus de l&rsquo;\u00e9tat de confusion qui r\u00e8gne dans les esprits des responsables de l\u2019administration de notre justice et sur la nature de la justice qu&rsquo;il ont \u00e0 l\u2019esprit et qui s&rsquo;identifie implacablement avec la r\u00e9pression qu&rsquo;ils exercent concr\u00e8tement et qui a de plus en plus du mal \u00e0 supporter ces parodie de proc\u00e8s avec lesquels nos magistrat voient leur honneur souill\u00e9 \u00e0 longueur des jours, des mois et des ann\u00e9es.  Dans un syst\u00e8me politique bas\u00e9 sur des intuitions dignes de ce nom et avec une justice digne de respect aucun responsable politique ne peut m\u00eame penser \u00e0 interf\u00e9rer dans un proc\u00e8s en cours pour accabler un citoyen avant que la justice n&rsquo;ait dit son dernier mot sur son cas. Les citoyens ne sont-ils pas \u00e9gaux devant la loi en vertu de la constitution comme ces m\u00eames autorit\u00e9s sont entrain de le ressasser ? Mais leur fiabilit\u00e9 avait \u00e9t\u00e9 contest\u00e9e car ils avaient \u00e9t\u00e9 reconstitu\u00e9s \u00e0 partir de discussions informelles organis\u00e9es au sein d\u2019une acad\u00e9mie militaire. <\/span><\/p>\n<p><span>Cette fois, Shovrim Shtika, une organisation qui s\u2019\u00e9tait jusque-l\u00e0 attach\u00e9e \u00e0 recueillir les t\u00e9moignages de soldats servant dans les territoires palestiniens, retranscrit de fa\u00e7on syst\u00e9matique des entretiens avec des conscrits et des soldats de r\u00e9serve, sous couvert de l\u2019anonymat. Des extraits de son rapport sont publi\u00e9s aujourd\u2019hui dans le quotidien isra\u00e9lien de gauche <i>Haaretz.<\/i> <\/span><\/p>\n<p><b><span>Phosphore.<\/span><\/b><span> Des enqu\u00eates de l\u2019ONU et de diff\u00e9rentes organisations de d\u00e9fense des droits de l\u2019homme avaient d\u00e9j\u00e0 fait le tour des principaux chefs d\u2019accusation qui p\u00e8sent sur Tsahal\u00a0: utilisation de civils comme boucliers humains, tirs injustifi\u00e9s contre des civils, usage de bombes au phosphore blanc dans des zones habit\u00e9es. Tous ces \u00e9l\u00e9ments figurent l\u00e0 encore dans les t\u00e9moignages des soldats. Mais c\u2019est le laxisme des r\u00e8gles d\u2019engagement, voire leur absence, qui est l\u2019\u00e9l\u00e9ment le plus troublant du rapport. Ainsi le t\u00e9moignage d\u2019un des soldats\u00a0: <i>\u00abSi nous d\u00e9tectons quoi que soit qui ne doit pas \u00eatre l\u00e0, nous avons ordre de tirer. On nous explique que de toute fa\u00e7on l\u2019arm\u00e9e de l\u2019air a l\u00e2ch\u00e9 des prospectus pour dire \u00e0 tous les habitants de partir, et que plus personne ne doit \u00eatre l\u00e0. J\u2019entends des histoires d\u2019autres unit\u00e9s qui tirent sur des gens distants de deux\u00a0kilom\u00e8tres. Ils essaient de les tuer. Ce sont de jeunes soldats, qui veulent marquer des points. Comme si c\u2019\u00e9tait cool d\u2019avoir un tel pouvoir sans personne pour vous freiner.\u00bb<\/i><\/span><\/p>\n<p><b><span>\u00abTerroriste\u00bb.<\/span><\/b><span> Un autre soldat explique comment, une nuit, un Palestinien s\u2019est approch\u00e9 de la maison occup\u00e9e par son unit\u00e9, dans le quartier de Zeitoun, dans la p\u00e9riph\u00e9rie de la ville de Gaza. Malgr\u00e9 les demandes r\u00e9p\u00e9t\u00e9es de ses soldats, le commandant refuse qu\u2019ils le dissuadent de continuer dans leur direction en tirant. Le civilest abattu.<i> \u00abPlus tard, des soldats ont demand\u00e9 au commandant pourquoi il ne nous avait pas laiss\u00e9 avertir le Palestinien. A chaque fois il r\u00e9pondait que c\u2019\u00e9tait parce que c\u2019\u00e9tait la nuit et qu\u2019il s\u2019agissait d\u2019un terroriste, m\u00eame si aucune arme n\u2019avait \u00e9t\u00e9 retrouv\u00e9e sur lui. L\u2019impression g\u00e9n\u00e9rale \u00e9tait qu\u2019on \u00e9tait ici pour tuer et que cela ne perturbait personne\u00bb,<\/i> relate-t-il.<\/span><\/p>\n<p><i><span>\u00abIl y a des bavures et des d\u00e9rapages dans toutes les guerres, mais ce qui nous trouble, c\u2019est de voir que, lors de son op\u00e9ration \u00e0 Gaza, l\u2019arm\u00e9e isra\u00e9lienne semble avoir chang\u00e9 ses concepts \u00e9thiques sans nous le dire. L\u2019utilisation de tactiques de guerre contre les civils palestiniens est injustifiable\u00bb,<\/span><\/i><span> commente Yehuda Shaul, directeur de Shovrim Shtika.<\/span><\/p>\n<p><span>Avant m\u00eame leur publication, l\u2019arm\u00e9e isra\u00e9lienne a remis en question la fiabilit\u00e9 de ces t\u00e9moignages. Pour Asa Kasher, professeur de philosophie \u00e0 l\u2019universit\u00e9 de Tel-Aviv, auteur du code d\u2019\u00e9thique de l\u2019arm\u00e9e,<i>\u00abcette organisation [Shovrim Shtika] se targue de d\u00e9fendre des valeurs morales alors qu\u2019elle a en fait un agenda politique\u00a0: aller dans le sens des accusations palestiniennes.\u00bb<\/i> Il ajoute\u00a0:<i> \u00abQuand les soldats disent qu\u2019ils pouvaient tirer \u00e0 volont\u00e9\u00a0: soit ils ont agi de leur plein gr\u00e9 et c\u2019est condamnable, soit ils n\u2019ont pas refus\u00e9 les ordres de leur sup\u00e9rieur, ce qui est \u00e9galement condamnable. Les soldats ont l\u2019obligation l\u00e9gale de refuser des ordres ill\u00e9gaux, de tirer sur des innocents.
