Persons convicted under this article will face prison terms ranging from five to twenty-five years (article 62 of the Criminal Code, on internal security). The adoption of this amendment will enable the authorities to prosecute and imprison human rights defenders who are supported by foreign and multilateral organisations.   In his reply to statements made by parliamentarians, Justice and Human Rights Minister Lazhar Bououni said that \u201charming Tunisia\u2019s vital interests\u201d included \u201cinciting foreign parties not to grant loans to Tunisia, not to invest in the country, to boycott tourism or to sabotage Tunisia\u2019s efforts to obtain advanced partner status with the European Union\u201d[1]. The approval of this provision comes just one month after a meeting on May 11, 2010 of the Council of Association between the EU and Tunisia, and at a time when Tunisia has begun negotiations to obtain advanced partner status.   \u201cThis repressive decision is a flagrant violation of freedom of expression and is unquestionably designed to criminalise the act to bringing the human rights situation in Tunisia to the attention of international organisations\u201d, FIDH president Souhayr Belhassen said.  \u201cThis constitutes yet another blow to Tunisian civil society, which aim is to keep dissidents from being heard on the international stage,\u201d OMCT Secretary-General Eric Sottas added.   \u201cThis provision completes the Tunisian government\u2019s repressive arsenal against those figures who, internationally, dare to challenge the regime\u2019s policies. It opens the door to all kinds of abuses. The EU must not grant Tunisia advanced partner status as long as its government tries to gag all dissidents, as long as it makes systematic use of harassment, intimidation and censorship and as long as the criminal code is used to punish all dissenting views\u201d, RWB Secretary-General Fran\u00e7ois Julliard said.   \u201cHuman rights defenders are directly targeted by the new law,\u201d said EMHRN President Kamel Jendoubi. \u201cEven before its adoption, articles published in newspapers such as Al-Hadath, Kol an-nass, As-Sarih, As-Sabah, La Presse and Ach-Chourouk were branding certain Tunisian activists[2] as \u2018traitors,\u2019 \u2018agents\u2019 and \u2018mercenaries\u2019 who \u2018should be brought to trial\u2019[3] for being in contact with the EU. But the law also aims to silence Tunisians who would speak critically to the international community\u201d.   These attacks have intensified in recent weeks, with activists being openly held responsible for any \u201cfailure in the negotiations for advanced partner status with the EU\u201d[4]. In addition, when Kh\u00e9ma\u00efs Chammari arrived at Tunis International Airport from Paris on 15 June, he was subjected to an abusive and humiliating customs inspection that lasted 65 minutes and led to the confiscation of one of his books.   \u201cAfter trying to suppress all those who express independent views inside Tunisia, the authorities want to use this measure to extend their control to the international arena, where they would control activists and prevent denunciation of the violations being committed on a daily basis in Tunisia,\u201d said Hassiba Hadj Sahraoui of Amnesty International.   The Observatory, EMHRN, RWB, Amnesty International and Human Rights Watch fear that the adoption of this law will result in an increase in harassment of human rights activists in Tunisia and will allow the authorities to bring arbitrary prosecutions against activists and all those who urge the international community to do what is necessary to encourage an improvement in the human rights situation in Tunisia.   Our organisations hereby call upon the Tunisian authorities to repeal this law without delay, inasmuch as its provisions are clearly contrary to the spirit and letter of the International Covenant on Civil and Political Rights, which Tunisia ratified on 23 March 1976; and to comply with the Declaration on Human Rights Defenders adopted by the General Assembly of the United Nations on 9 December 1998 and with the regional and international instruments on human rights ratified by Tunisia.   Our organisations also call upon the EU institutions to examine any upgrading of EU relations with Tunisia by the yardstick of significant and measurable progress in respect for international human rights standards and to immediately implement the EU Guidelines on Human Rights Defenders. Cet amendement gouvernemental \u00e0 l\u2019article 61 bis du code p\u00e9nal a \u00e9t\u00e9 adopt\u00e9 par le Parlement, \u00e0 la quasi-unanimit\u00e9, le 15 juin.  Qui est vis\u00e9\u2009? Devant les d\u00e9put\u00e9s, Lazhar Bououni, le ministre de la Justice et des Droits de l\u2019homme, a estim\u00e9 que \u00ab la formulation d\u2019une opinion, m\u00eame si elle entra\u00eene un pr\u00e9judice, ne saurait \u00eatre criminalis\u00e9e \u00bb. En revanche, la loi punira \u00e0 l\u2019avenir toute personne \u00ab incitant des parties \u00e9trang\u00e8res \u00e0 ne pas accorder de cr\u00e9dits \u00e0 la Tunisie, \u00e0 ne pas investir dans le pays ou \u00e0 boycotter le tourisme \u00bb. Le m\u00eame jour, Abdelwahab Abdallah, ministre-conseiller aupr\u00e8s du pr\u00e9sident Ben Ali charg\u00e9 des Affaires politiques, mettait en cause une \u00ab minorit\u00e9 d\u00e9pourvue de tout sens patriotique \u00bb qui r\u00eave \u00ab d\u2019entraver la promotion de la Tunisie au rang de \u201cpartenaire avanc\u00e9\u201d de l\u2019Union europ\u00e9enne \u00bb. Parmi les t\u00e9nors de la soci\u00e9t\u00e9 civile pris pour cible figure<a target=\"_blank\" rel=\"noopener\">Khema\u00efs Chammarri<\/a>, un v\u00e9t\u00e9ran des droits de l\u2019homme que des m\u00e9dias locaux qualifient volontiers de \u00ab tra\u00eetre \u00bb. La Ligue tunisienne de d\u00e9fense des droits de l\u2019homme (LTDH) voit dans la nouvelle loi \u00ab un danger pour les libert\u00e9s publiques \u00bb. Elle est faite pour \u00ab terroriser l\u2019opposition \u00bb, rench\u00e9rit <a target=\"_blank\" rel=\"noopener\">Mustapha\u00ad Ben Jaafar<\/a>, le tr\u00e8s mod\u00e9r\u00e9 secr\u00e9taire g\u00e9n\u00e9ral du Forum d\u00e9mocratique pour le travail et les libert\u00e9s (FDTL). S\u2019efforcer de comprendre est devenue dans la Tunisie d\u2019aujourd\u2019hui une position r\u00e9volutionnaire et qui ne va pas sans risque. Etre, si l\u2019on peut dire, du c\u00f4t\u00e9 de Ben Ali, c\u2019est voir en lui le type m\u00eame de toute autorit\u00e9. Point de partage. Il est con\u00e7u avec sa puissance souveraine pour r\u00e9gner en ma\u00eetre. Alors \u00e0 quoi bon de r\u00e9fl\u00e9chir et de penser, notre \u00ab bien faiteur \u00bb le fait pour nous. Et cette force quasi divine Ben Ali la transmet sous forme de privil\u00e8ge \u00e0 sa famille. Une famille mue par des mobiles politiques, \u00e9conomiques et sociaux. C\u2019est parce qu\u2019une certaine organisation de l\u2019Etat lui para\u00eet s\u2019opposer \u00e0 son int\u00e9r\u00eat qu\u2019elle l\u2019attaque. Rien, absolument rien, ne doit lui \u00e9chapper. Il faut s\u2019approprier tout. La psychanalyse nous a r\u00e9v\u00e9l\u00e9 que cette fr\u00e9n\u00e9sie totalisante d\u2019appropriation sans rel\u00e2che des biens d\u2019autrui (publics et priv\u00e9s) est la r\u00e9sultante d\u2019une haine inconsciente d\u2019un pass\u00e9 qui ne passe pas. Mais ce trouble psychologique qui aurait pu rester dans la sph\u00e8re priv\u00e9e encombre aujourd\u2019hui le pays et menace son avenir. Il rel\u00e8ve de la politique. Il est m\u00eame devenu la principale pr\u00e9occupation des tunisiens. Tout ce que le pays est capable de cr\u00e9er, d\u2019inventer, de produire et de transformer se trouve (directement ou indirectement) entre les mains des diff\u00e9rents clans de la famille. Et tous les services de l\u2019Etat (minist\u00e8res, administrations) et tous les compartiments de la soci\u00e9t\u00e9 tunisienne sont mobilis\u00e9s pour les servir. C\u2019est un d\u00fb. Que fait alors Ben Ali au sujet de ce ph\u00e9nom\u00e8ne ? Rien. Il ne fait rien. Au contraire, il s\u2019est \u00e9rig\u00e9 en pr\u00e9sident facilitateur. \u00a0 Que dit Mohamed Sayah \u00e0 l\u2019\u00e9gard de cette appropriation du pays et de sa richesse par une minorit\u00e9 d\u2019individus dont le seul m\u00e9rite est d\u2019\u00eatre membre ou proche de la famille r\u00e9gnante ? M\u00eame s\u2019il ne s\u2019est jamais exprim\u00e9 publiquement sur cette question, son attitude, son action et ses dires sont un rejet sans concession\u00a0 de cette spoliation. Il la rejette non seulement pour ce qu\u2019elle repr\u00e9sente en tant que valeur d\u00e9formante de l\u2019\u00e9thique, mais \u00e9galement en tant que fl\u00e9au dangereux pour la stabilit\u00e9 du pays. En effet, voir la Tunisie\u00a0 se transformer petit \u00e0 petit en lots privatifs \u00e0 distribuer au plus gourmand ne doit\u00a0 produire en lui que d\u00e9go\u00fbt et rejet. C\u2019est un \u00ab choc des cultures \u00bb. Lui, qui a consacr\u00e9 sa carri\u00e8re politique \u00e0 servir l\u2019Etat et \u00e0 \u00eatre au service de ses compatriotes, cette Tunisie de Ben Ali et de sa famille ne pourrait que le r\u00e9volter. Il y d\u00e9nonce la disparition du sens de l\u2019Etat et la perte des valeurs. Or\u00a0 que signifie, dans la bouche de Mohamed Sayah, le sens de l\u2019Etat? Que repr\u00e9sente une telle notion pour un grand commis de l\u2019Etat comme lui ? Reprenons, pour d\u00e9gager notre r\u00e9ponse, le proc\u00e9d\u00e9 d\u00e9j\u00e0 employ\u00e9 lors de la premi\u00e8re partie de notre \u00e9tude : nous allons nous r\u00e9f\u00e9rer \u00e0 l\u2019attitude de l\u2019homme et \u00e0 son \u0153uvre.  \u00a0 Pour lui, l\u2019Etat n\u2019existe ni dans l\u2019instant ni dans l\u2019\u00e9ternit\u00e9, mais dans une dur\u00e9e qui se nourrit d\u2019\u00e9ternit\u00e9. Et c\u2019est pourquoi, comme tout ce qu\u2019il y a de grand et d\u2019important, le sens de l\u2019Etat est une valeur, c\u2019est-\u00e0-dire une croyance dans la dur\u00e9e : plus elle dure, plus elle s\u2019accomplit. Ainsi la sagesse des gouvernants l\u00e9gitimes, contre la courte sagesse des imposteurs, place-t-elle le sens de l\u2019Etat avant les int\u00e9r\u00eats personnels et voit dans l\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral un enrichissement collectif qui ne cesse pas. Dans son action pass\u00e9e et son discours actuel, Mohamed Sayah consid\u00e8re que le pouvoir n\u2019appartient qu\u2019\u00e0 l\u2019Etat, les responsables politiques ne peuvent en aucune fa\u00e7on s\u2019en saisir et en user pour leur profit personnel. La puissance qu\u2019ils d\u00e9tiennent, ils doivent la mettre au service exclusif de la collectivit\u00e9. Ostensiblement d\u00e9tach\u00e9 \u00e0 l\u2019\u00e9gard de l\u2019argent, Mohamed Sayah a toujours montr\u00e9 que le pouvoir n\u2019a jamais constitu\u00e9 pour lui une jouissance, mais une charge dont il faut s\u2019acquitter avec altruisme. Il a d\u00e9lib\u00e9r\u00e9ment renonc\u00e9 \u00e0 faire fortune. Et c\u2019est cela m\u00eame qui lui assure aujourd\u2019hui la libert\u00e9 et la disponibilit\u00e9 d\u2019esprit indispensable pour d\u00e9montrer aux tunisiens qu\u2019une autre voie demeure possible. Aussi, ce \u00ab pas-d\u2019argent \u00bb qui le caract\u00e9rise, l\u2019investit d\u2019une \u00e9crasante sup\u00e9riorit\u00e9 morale sur les gouvernants actuels exclusivement pr\u00e9occup\u00e9s de satisfaire leurs int\u00e9r\u00eats particuliers. Par ce biais, se trouve ainsi trac\u00e9e une coupure d\u00e9cisive entre les valeurs qui sont les siennes et celles d\u2019un Ben Ali et son entourage.  \u00a0 Cette conception le conduit tout naturellement \u00e0 faire preuve de prudence. La meilleure garantie d\u2019\u00eatre neutre et au service de l\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral, c\u2019est encore de ne pas m\u00ealer \u00ab Affaires \u00bb et politique. Pour\u00a0 lui, un homme d\u2019Etat digne de ce nom ne doit en aucun cas confondre ce deux mondes. Son intervention en la mati\u00e8re doit \u00eatre essentiellement command\u00e9e par la volont\u00e9 de maintenir ou r\u00e9tablir l\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral qui n\u2019est nullement r\u00e9ductible \u00e0 la somme des int\u00e9r\u00eats particuliers. Mieux encore, pour Mohamed Sayah, int\u00e9r\u00eat g\u00e9n\u00e9ral et int\u00e9r\u00eats particuliers sont en relation d\u2019opposition dialectique : l\u2019int\u00e9r\u00eat collectif de la soci\u00e9t\u00e9 entre in\u00e9vitablement en conflit avec les int\u00e9r\u00eats individuels des membres, contre lesquels il doit \u00eatre d\u00e9fendu et impos\u00e9. C\u2019est le sens m\u00eame de l\u2019Etat, selon lui. Or dans la Tunisie de Ben Ali, l\u2019Etat n\u2019est invoqu\u00e9 que pour s\u2019y mettre \u00e0 l\u2019abri. C\u2019est le refuge de la l\u00e2chet\u00e9 et de la malhonn\u00eatet\u00e9. Le retournement est complet. Il n\u2019y a pas lieu de s\u2019enorgueillir, mais plut\u00f4t de s\u2019en inqui\u00e9ter. La vie politique en Tunisie est d\u00e9sormais rythm\u00e9e par une succession de vols \u00e0 ciel ouvert et d\u2019affaires malsaines exclusivement men\u00e9s pour le compte d\u2019un clan notoirement identifi\u00e9. L\u2019Etat\u00a0 et ses repr\u00e9sentants\u00a0 sont alors instrumentalis\u00e9s pour r\u00e9aliser cet \u00ab enrichissement sans cause \u00bb. Mohamed Sayah, ne peut en \u00eatre d\u2019accord. Il faut dire \u00ab Non \u00bb, aime-t-il r\u00e9p\u00e9ter. Mais il sait aussi que la r\u00e9sistance ne peut \u00eatre g\u00e9n\u00e9rale et absolue. Qu\u2019il y a plusieurs mani\u00e8res de r\u00e9sister. C\u2019est pourquoi, il cherche \u00e0 r\u00e9injecter cette attitude chez les Tunisiens sans les culpabiliser mais tout en les encourageant \u00e0 r\u00e9sister, chacun \u00e0 sa mani\u00e8re et selon ses moyens. Car la confiance en soi, dit-il, rend possible non seulement\u00a0 une autre d\u00e9marche, mais surtout un espoir nouveau. L\u2019id\u00e9e d\u2019un peuple vigilant, courageux \u00e9tait certes inutile \u00e0 une \u00e9poque o\u00f9 les citoyens attendaient protection, s\u00e9curit\u00e9 et de la bienveillance d\u2019un Etat neutre et au service de tous. Mais aujourd\u2019hui cet Etat s\u2019est d\u00e9sagr\u00e9g\u00e9, il s\u2019est ins\u00e9r\u00e9 dans le patrimoine de la famille r\u00e9gnante qui a renvers\u00e9 les sch\u00e8mes et cherche \u00e0 imposer ses int\u00e9r\u00eats particuliers par tous les moyens et sans limites. Que voulez-vous ? On ne croit plus maintenant, chez ces gens l\u00e0, aux \u00ab veilles lunes \u00bb (le bien commun, le d\u00e9veloppement du pays, int\u00e9r\u00eat g\u00e9n\u00e9ral\u2026.). Le ma\u00eetre mot : c\u2019est piller.  \u00a0 23 ans apr\u00e8s le coup d\u2019Etat, Mohamed Sayah reste fid\u00e8le aux principes bourguibiens. Oettinger, selon un communiqu\u00e9 de la d\u00e9l\u00e9gation de l&rsquo;Union europ\u00e9enne (UE) en Alg\u00e9rie. M. Oettinger s&rsquo;exprimait \u00e0 l&rsquo;issue de la premi\u00e8re r\u00e9union du conseil minist\u00e9riel maghr\u00e9bin, dans le cadre du projet d&rsquo;int\u00e9gration progressive des march\u00e9s de ces trois pays du Maghreb au march\u00e9 de l&rsquo;\u00e9lectricit\u00e9 de l&rsquo;Union europ\u00e9enne. Les ministres alg\u00e9rien de l&rsquo;Energie et des Mines, Youcef Yousfi, marocain de l&rsquo;Energie, Amina Benkhedra et tunisien de l&rsquo;Industrie, Affif Chelbi ainsi que M. Oettinger ont pris part \u00e0 cette r\u00e9union. M. Yousfi a soulign\u00e9 que l&rsquo;Alg\u00e9rie, le Maroc et la Tunisie avaient entrepris \u00ab\u00a0la construction de lignes d&rsquo;interconnexions de grande puissance (&#8230;) qui constitue un premier jalon pour le futur march\u00e9 maghr\u00e9bin de l&rsquo;\u00e9lectricit\u00e9\u00a0\u00bb. Les travaux de la cette r\u00e9union ont \u00e9t\u00e9 sanctionn\u00e9s par l&rsquo;adoption d&rsquo;une d\u00e9claration finale et d&rsquo;un plan d&rsquo;action pour la p\u00e9riode 2010-2015, selon la d\u00e9claration finale. Les ministres pr\u00e9sents ont confirm\u00e9 \u00ab\u00a0leur volont\u00e9 de poursuivre les r\u00e9formes de leurs secteurs \u00e9nerg\u00e9tiques nationaux\u00a0\u00bb, et sont convenus que l&rsquo;acc\u00e8s aux r\u00e9seaux doit \u00eatre \u00ab\u00a0non discriminatoire et transparent et faire l&rsquo;objet d&rsquo;une tarification ad\u00e9quate\u00a0\u00bb, ajoute le texte. The European Union is backing projects to turn the plentiful sunlight in the Sahara desert into electricity for power-hungry Europe, a scheme it hopes will help meet its target of deriving 20 percent of its energy from renewable sources in 2020. \u00ab\u00a0I think some models starting in the next 5 years will bring some hundreds of megawatts to the European market,\u00a0\u00bb Oettinger told Reuters after a meeting with energy ministers from Algeria, Morocco and Tunisia. He said those initial volumes would come from small pilot projects, but the amount of electricity would go up into the thousands of megawatts as projects including the 400 billion euro Desertec solar scheme come on stream. \u00ab\u00a0Desertec as a whole is a vision for the next 20 to 40 years with investment of hundreds of billions of euros,\u00a0\u00bb said Oettinger. \u00ab\u00a0To integrate a bigger percentage of renewables, solar and wind, needs time.\u00a0\u00bb The EU is backing the construction of new electricity cables, known as inter-connectors, under the Mediterranean Sea to carry this renewable energy from North Africa to Europe. Some environmental groups have warned these cables could be used instead to import non-renewable electricity from coal- and gas-fired power stations in north Africa. \u00ab\u00a0This is a good question but not a question to destroy our project,\u00a0\u00bb Oettinger said. \u00ab\u00a0This question must be answered by a good answer and so we need ways to ensure that our import of electricity is from renewables.\u00a0\u00bb He said he believed it was technologically possible to monitor electricity imports to the EU and establish if they come from renewable sources or fossil fuels. \u00ab\u00a0This question must be solved in the next years,\u00a0\u00bb he said. SOLAR SUBSIDIES The Desertec consortium includes major firms such as Siemens, RWE and Deutsche Bank. They are expected to seek public money for the project. Oettinger said the EU&rsquo;s assistance was likely to include help coordinating stakeholders, updating regulations to allow the imported electricity to move across European borders, and financing feasibility studies. On the prospect of EU subsidies, or the European Commission permitting state aid to firms involved in the project, he said that would become clear once the consortium has presented a detailed business plan. Oettinger said all three energy ministers at the meeting in the Algerian capital sent a signal they were willing to build the infrastructure and common market rules needed to allow a trade in renewable electricity with Europe.
