Par contre la majorit\u00e9 d\u2019entre eux se   trouvent au seuil de la pauvret\u00e9 alors qu\u2019ils avaient promis \u00e0 leur famille   richesse et aisance et\u00a0 une vie en rose\u00a0; d\u2019autant plus que les enfants ont   grandi entre temps et que leurs demandes et leurs besoins ont grandi aussi.<\/span><\/b><\/p>\n<p dir=\"ltr\">  \u00a0<\/p>\n<p dir=\"ltr\"> <b><span lang=\"FR-CH\">Tous les   r\u00eaves et les espoirs se sont envol\u00e9s, le travail se fait rare et les proches   et les amis ont tourn\u00e9s le dos\u00a0; certains d\u2019entre eux ont m\u00eame vu partir leurs   \u00e9pouses et leurs enfants.<\/span><\/b><\/p>\n<p dir=\"ltr\"> <b><span lang=\"FR-CH\">Il y a,   certes,\u00a0 des fr\u00e8res comme ceux cit\u00e9s par Allah\u00a0:\u00a0<span>\u00ab\u2026\u00a0<a><i>que   l&rsquo;ignorant croit riches parce qu&rsquo;ils ont honte de mendier &#8211; tu les   reconna\u00eetras \u00e0 leur aspects &#8211; Ils n&rsquo;importunent personne en mendiant<\/i>.<\/a>.\u00a0\u00bb<\/span>   La vache\/273 . Nous nous soucions d\u2019eux et nous ressentons ce qu\u2019ils   ressentent.<\/span><\/b><\/p>\n<p dir=\"ltr\"> <b><span lang=\"FR-CH\">Il y<span dir=\"rtl\"> <\/span>en a d\u2019autres qui, par pudeur, n\u2019ose pas sortir de chez eux refusant   tout contact ext\u00e9rieur\u00a0; craignant le regard des autres en raison de\u00a0 leur   pauvret\u00e9.<\/span><\/b><\/p>\n<p dir=\"ltr\">  \u00a0<\/p>\n<p dir=\"ltr\"> <b><span lang=\"FR-CH\">D\u2019autres   sollicitent\u00a0 Allah avant d\u2019aller affronter les gens et leur dire\u00a0\u00ab\u00a0donnez moi   \u00e0 manger j\u2019ai faim\u00a0\u00bb, et les cas similaires sont nombreux.<\/span><\/b><\/p>\n<p dir=\"ltr\">  \u00a0<\/p>\n<p dir=\"ltr\"> <b><span lang=\"FR-CH\">Chers   fr\u00e8res, cette crise qui a longtemps dur\u00e9 a engendr\u00e9 des cons\u00e9quences et des   situations n\u00e9fastes.<\/span><\/b><\/p>\n<p dir=\"ltr\">  \u00a0<\/p>\n<p dir=\"ltr\">  Nos fr\u00e8res qui sont rest\u00e9s en prison parfois plus de quatorze ans se sont   retrouv\u00e9s dans des situations alarmantes\u00a0:<\/p>\n<p dir=\"ltr\">  \u00a0<\/p>\n<p dir=\"ltr\">  Certains ont atteint la cinquantaine et sont toujours c\u00e9libataires, ajout\u00e9 \u00e0   cela de nombreuses maladies de l\u2019estomac, du rein, le ph\u00e9nom\u00e8ne d\u2019impuissance   sexuelle, le cancer\u00a0 entra\u00eenant\u00a0 la mort dans de nombreux cas.<\/p>\n<p dir=\"ltr\">  \u00a0<\/p>\n<p dir=\"ltr\"> <b><span lang=\"FR-CH\">Le pire   c\u2019est que la majorit\u00e9 de ces fr\u00e8res sont priv\u00e9s de cartes de soins et certains   d\u2019entres eux sont au ch\u00f4mage ou en invalidit\u00e9.<\/span><\/b><\/p>\n<p dir=\"ltr\">  \u00a0<\/p>\n<p dir=\"ltr\"> <b><span lang=\"FR-CH\">La   situation\u00a0 de leurs enfants est parfois plus alarmante. De nombreux sont ceux   qui pr\u00e9sentent des maladies psychologiques du fait du stress permanent   entra\u00eenant des perturbations graves, et comme vous le savez, ces cas   n\u00e9cessitent de l\u2019attention, de la pr\u00e9vention et une prise en charge permanente   qui est co\u00fbteuse.<\/span><\/b><\/p>\n<p dir=\"ltr\">  \u00a0<\/p>\n<p dir=\"ltr\"> <b><span lang=\"FR-CH\">Tout cela   n\u2019est qu\u2019un aper\u00e7u de la r\u00e9alit\u00e9, une goutte dans un oc\u00e9an.<\/span><\/b><\/p>\n<p dir=\"ltr\">  \u00a0<\/p>\n<p dir=\"ltr\"> <b><span lang=\"FR-CH\">Chers   fr\u00e8res, la lecture de cette lettre ne doit pas vous laisser indiff\u00e9rents, nous   sommes persuad\u00e9s qu\u2019apr\u00e8s sa lecture votre c\u0153ur sera touch\u00e9.<\/span><\/b><\/p>\n<p dir=\"ltr\">  \u00a0<\/p>\n<p dir=\"ltr\"> <b><span lang=\"FR-CH\">Notre espoir   en Dieu est grand ainsi qu\u2019en votre g\u00e9n\u00e9rosit\u00e9 devant pareil cas de d\u00e9nuement   et de pauvret\u00e9.<\/span><\/b><\/p>\n<p dir=\"ltr\">  \u00a0<\/p>\n<p dir=\"ltr\"> <b><span lang=\"FR-CH\">Nous ne   souhaitions \u00e0 personne de vivre cette situation. Il     semblerait que l\u2019administration de la prison de Mornaguia ait voulu le     torturer pour avoir protest\u00e9 sans cesse contre les mauvais traitements,     notamment la n\u00e9gligence. En effet l\u2019eau a \u00e9t\u00e9 coup\u00e9e dans sa cellule en     raison de fuites dans la canalisation qui n\u2019ont pas \u00e9t\u00e9 r\u00e9par\u00e9es alors que     cela dure depuis longtemps.     * La famille de monsieur Hassan Chebbi, un instituteur en poste \u00e0 l\u2019Ariana,     nous a inform\u00e9s que la police politique l\u2019avait arr\u00eat\u00e9 lundi 8 octobre 2007     \u00e0 cinq heures de l\u2019apr\u00e8s midi sans que la famille ne soit inform\u00e9e des     raisons de cette arrestation. Les \u00e9l\u00e8ves ont \u00e9t\u00e9 priv\u00e9s de cours le mardi 9     octobre, et \u00e0 l\u2019heure o\u00f9 nous \u00e9crivons ces lignes, il n\u2019a pas \u00e9t\u00e9 lib\u00e9r\u00e9.     * La famille de monsieur Lassaad Mermech qui a \u00e9t\u00e9 arr\u00eat\u00e9 au d\u00e9but de     l\u2019ann\u00e9e 2007, une semaine apr\u00e8s son mariage, et qui se trouve actuellement \u00e0     la prison de Mornaguia, a dit, -et elle le tient de son fils lors de la     visite qu\u2019elle lui a rendue vendredi 5 octobre-, qu\u2019il avait \u00e9t\u00e9 soumis \u00e0     toutes formes de torture dans les locaux de la S\u00fbret\u00e9 de l\u2019Etat et que des     investigations \u00e9taient toujours en cours concernant ses convictions et     pratiques religieuses.     * Nous avons \u00e9t\u00e9 contact\u00e9s par l\u2019\u00e9tudiante Amel Ben Rouhouma qui nous a dit     \u00eatre inscrite \u00e0 l\u2019\u00e9cole sup\u00e9rieure d\u2019ing\u00e9nieurs en \u00e9quipement agricole de     Majez El Bab depuis quatre ans. Elle s\u2019est inscrite cette ann\u00e9e pour suivre     les cours de derni\u00e8re ann\u00e9e mais le directeur de l\u2019\u00e9cole a donn\u00e9 des     consignes afin qu\u2019elle et sa coll\u00e8gue, l\u2019\u00e9tudiante Hajer Ben Mohammed, se     voient interdire l\u2019entr\u00e9e dans l\u2019\u00e9cole et les cours qui ont commenc\u00e9 le 17     septembre 2007, en raison du voile qu\u2019elles portent. Pour cette raison     aussi, elles ne peuvent habiter au foyer des \u00e9tudiantes, ce qui les a     contraintes \u00e0 se loger dans le priv\u00e9 \u00e0 Majez El Bab, \u00e0 plusieurs kilom\u00e8tres     de l\u2019\u00e9cole, leur occasionnant des d\u00e9penses suppl\u00e9mentaires de transport,     lequel est presque inexistant dans cette r\u00e9gion. La gr\u00e8ve de la faim prendra fin, t\u00f4t ou tard. Forts de l\u2019exp\u00e9rience   de la gr\u00e8ve de la faim du 18 octobre, nous savons qu\u2019une gr\u00e8ve de la faim,   m\u00eame m\u00e9diatis\u00e9e et ayant d\u00e9clench\u00e9 une empathie plan\u00e9taire, peut prendre fin   sans pour autant avoir cr\u00e9\u00e9 de nouvelles conditions de lutte, et que les   structures qui la \u00ab\u00a0soutiennent\u00a0\u00bb s\u2019effondrent sit\u00f4t finie la gr\u00e8ve, comme un   ch\u00e2teau de cartes.<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">La gr\u00e8ve de la   faim de N\u00e9jib Chebbi et Maya Jribi n\u2019est sans doute pas aussi m\u00e9diatis\u00e9e que   celle du 18 octobre, mais l\u2019essentiel n\u2019est pas l\u00e0 : elle survient dans un   contexte diff\u00e9rent, porteur de potentialit\u00e9s politiques qui pourraient   s\u2019av\u00e9rer prometteuses, \u00e0 condition que nous nous y mettions. <\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">La remont\u00e9e des   luttes sociales, l\u2019effervescence \u00e0 l\u2019universit\u00e9, la combativit\u00e9 de secteurs   syndicaux, la col\u00e8re des ch\u00f4meurs dipl\u00f4m\u00e9s, l\u2019audace des familles de   prisonniers en est concomitante. <\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">D\u00e9j\u00e0 on a vu des   d\u00e9l\u00e9gations de syndicalistes enseignants au local des gr\u00e9vistes. Les nouveaux dirigeants fran\u00e7ais   s&rsquo;\u00e9poumonent et s&rsquo;affichent, de Tripoli \u00e0 Kaboul, de Bogota \u00e0 Rangoon, pour   exprimer compassion et soutien aux victimes de tyrannies \u00ab\u00a0ennemies\u00a0\u00bb. Le 15 juillet 1995, il se   marie avec une ressortissante fran\u00e7aise. Un an plus tard, il est p\u00e8re d\u2019un   enfant. Lui-m\u00eame obtient la nationalit\u00e9 fran\u00e7aise en mars 2000. <\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">En novembre 2001,   il est \u00e9crou\u00e9 et condamn\u00e9 \u00e0 une peine de six ans d\u2019emprisonnement pour \u00ab   association de malfaiteurs en relation avec une entreprise terroriste \u00bb dans   le cadre d\u2019une affaire li\u00e9e \u00e0 l\u2019assassinat du Commandant Massoud. Il divorce   en 2004 alors qu\u2019il est emprisonn\u00e9. Il ach\u00e8ve sa peine en juillet 2006, mais   la veille de sa sortie du centre de d\u00e9tention de Nantes, soit le 21 juillet,   lui est notifi\u00e9e une d\u00e9cision de d\u00e9ch\u00e9ance de sa nationalit\u00e9 fran\u00e7aise, -prise   au terme d\u2019une proc\u00e9dure engag\u00e9e un mois plus tot (1)- par le Ministre de   l\u2019Emploi, de la Coh\u00e9sion sociale et du Logement (il s\u2019agit \u00e0 l\u2019\u00e9poque de   Jean-Louis Borloo). Il saisit imm\u00e9diatement la Pr\u00e9fecture pour demander   l\u2019asile. <\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">Le lendemain, la   lev\u00e9e d\u2019\u00e9crou est assortie d\u2019un arr\u00eat\u00e9 minist\u00e9riel d\u2019expulsion (Nicolas   Sarkozy est alors ministre de l\u2019Int\u00e9rieur), pris \u00ab en urgence absolue \u00bb pour \u00ab   n\u00e9cessit\u00e9 imp\u00e9rieuse pour la s\u00fbret\u00e9 de l\u2019Etat \u00bb(2), d\u2019un refus de la   pr\u00e9fecture de lui donner un titre de s\u00e9jour accompagnant sa demande d\u2019asile,   et d\u2019un arr\u00eat\u00e9 pr\u00e9fectoral de placement en r\u00e9tention. Il est illico achemin\u00e9   vers une destination qu\u2019il ignore, en r\u00e9alit\u00e9 le centre de r\u00e9tention du   Mesnil-Amelot, \u00e0 proximit\u00e9 de l\u2019a\u00e9roport de Roissy. Un autre arr\u00eat\u00e9   minist\u00e9riel fixe le m\u00eame jour la Tunisie comme pays de destination pour le   renvoi d\u2019Adel Tebourski (3).<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">D\u00e8s lors, le plan   ourdi par les autorit\u00e9s fran\u00e7aises ne devait souffrir aucune alt\u00e9ration ni   retard. La suite est \u00e9difiante :<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">Le 23 juillet, le   juge de la d\u00e9tention et des libert\u00e9s de Meaux prolonge son maintien en   r\u00e9tention pour quinze jours. Le 24, Adel Tebourski demande la suspension de   l\u2019arr\u00eat\u00e9 pris \u00e0 son encontre, requ\u00eate rejet\u00e9e par le juge des r\u00e9f\u00e9r\u00e9s le 26   par ordonnance. Le m\u00eame jour, il saisit, via son avocat, ma\u00eetre Franck Boezec,   la Cour Europ\u00e9enne des droits de l\u2019homme. <\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">Le 26 juillet,   Adel Tebourski, d\u00e9pose une requ\u00eate en annulation, accompagn\u00e9e d\u2019une demande de   suspension, qui sera audienc\u00e9e le 4 ao\u00fbt. Le m\u00eame jour, il saisit par   l\u2019interm\u00e9diaire de l\u2019ACAT et de la CIMADE le Comit\u00e9 contre la Torture de   l\u2019ONU. D\u00e8s le 27, le haut commissariat au droits de l\u2019homme de l\u2019ONU prie \u00ab   l\u2019Etat-partie [la France] de ne pas renvoyer M. Adel Tebourski \u00e0 la Tunisie   pendant que la requ\u00eate est examin\u00e9e par le Comit\u00e9. Cette demande est formul\u00e9e   sur la base des informations contenues dans la requ\u00eate \u00bb (4). <\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">Le 27 juillet, il   apprend qu\u2019il sera pr\u00e9sent\u00e9 au Consul de Tunisie, dans le but de se faire   d\u00e9livrer un laisser-passer, car il n\u2019a pas de passeport tunisien. Le m\u00eame   jour, il est entendu \u00e0 l\u2019Office Fran\u00e7ais pour la Protection des R\u00e9fugi\u00e9s et   Apatrides (OFPRA), car sa demande fait l\u2019objet d\u2019une proc\u00e9dure prioritaire,   soit un traitement en urgence. <\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">Le 28, sa demande   d\u2019asile est rejet\u00e9e par l\u2019OFPRA (5), et il est emmen\u00e9 au Consulat tunisien et   il d\u00e9couvre que le rejet par l&rsquo;OFPRA de sa demande d\u2019asile a \u00e9t\u00e9 transmis aux   autorit\u00e9s consulaires. Sit\u00f4t revenu au centre du Mesnil Amelot, il commence   une gr\u00e8ve de la faim et de la soif. <\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">Le 29 juillet, le   Tribunal Administratif de Paris rejette le second r\u00e9f\u00e9r\u00e9 libert\u00e9 d\u00e9pos\u00e9 par   Adel Tebourski (6). Lors de l\u2019audience, son avocat, Franck Boezec fait \u00e9tat   d\u2019un \u00ab ordre d\u2019acheminement \u00bb vers la Tunisie par bateau, pr\u00e9vu pour le lundi   suivant par bateau, ce \u00e0 quoi l\u2019avocate du minist\u00e8re de l\u2019Int\u00e9rieur, Ma\u00eetre   Sophie Tassel, r\u00e9torque qu\u2019il ne s\u2019agit que d\u2019une \u00ab r\u00e9servation \u00bb. <\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">D\u00e9j\u00e0 soutenu par   la CIMADE, la Ligue des Droits de l\u2019Homme et l\u2019Action des Chr\u00e9tiens pour   l\u2019Abolition de la Torture (ACAT), Adel Tebourski re\u00e7oit le 28 juillet le   soutien d\u2019Amnesty International (7). Le m\u00eame jour, lors du point-presse du   Quai d\u2019Orsay, le porte-parole du ministre ne r\u00e9pond pas \u00e0 la question du   journaliste : \u00ab je voudrais savoir si la France compte proc\u00e9der \u00e0 cette   expulsion ou si au contraire vous allez r\u00e9pondre \u00e0 l\u2019appel du Comit\u00e9 contre la   Torture de l\u2019ONU ?\u00bb et se r\u00e9fugie derri\u00e8re l\u2019OFPRA qui \u00ab se prononce en toute   ind\u00e9pendance \u00bb.<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">Le samedi 4 ao\u00fbt,   le Tribunal administratif rejette le troisi\u00e8me r\u00e9f\u00e9r\u00e9 contre l\u2019expulsion   d\u2019Adel Tebourski vers la Tunisie. Et le 7 ao\u00fbt, Adel Tebourski est emmen\u00e9 \u00e0   l\u2019a\u00e9roport de Roissy, et non au port de Marseille, comme une \u00ab fuite \u00bb bien   organis\u00e9e pour faire diversion l\u2019avait laiss\u00e9 entendre. Il arrive \u00e0 l\u2019a\u00e9roport   de Tunis-Carthage, o\u00f9 il est accueilli par les siens. Des effets personnels   sont saisis par la police de l\u2019a\u00e9roport.<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">Depuis un an, Adel   Tebourski \u00ab vit \u00bb en Tunisie, sous haute surveillance, comme un paria, priv\u00e9   de toute existence sociale. Il ne peut trouver d\u2019emploi. Il ne peut avoir de   relations normales avec son entourage sans que ce dernier ne soit \u00e0 son tour   surveill\u00e9.<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">Cette proc\u00e9dure   n\u2019aura dur\u00e9 que quinze jours. Quinze jours au cours desquels le matraquage   judiciaire a donn\u00e9 lieu \u00e0 quelques entorses au bon droit d\u2019Adel Tebourski. On   en retiendra quelques unes, d\u2019in\u00e9gale port\u00e9e :<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">\u00a0<\/span><\/p>\n<ul dir=\"ltr\" type=\"disc\">\n<li dir=\"ltr\">\n<p dir=\"ltr\"><span lang=\"FR\">    C\u2019est le 27 juillet et alors qu\u2019il est demandeur d\u2019asile, qu\u2019Adel Tebourski     est inform\u00e9 qu\u2019il sera emmen\u00e9 d\u00e8s le lendemain au Consulat de Tunisie. Il     est vrai qu\u2019il y est emmen\u00e9 apr\u00e8s avoir re\u00e7u notification de sa demande     d\u2019asile. Mais l\u2019annonce de sa pr\u00e9sentation signifie que l\u2019issue de la     proc\u00e9dure \u00e9tait connue d\u2019avance, d\u00e9cid\u00e9e ? <\/span><\/p>\n<\/li>\n<li dir=\"ltr\">\n<p dir=\"ltr\"><span lang=\"FR\">    Adel Tebourski constate que le rejet de sa demande d\u2019asile a \u00e9t\u00e9 transmis au     autorit\u00e9s consulaires de son pays, en violation flagrante de la     confidentialit\u00e9 de ce dossier. Le commandant de la gendarmerie du centre de     r\u00e9tention du Mesnil-Amelot lui pr\u00e9sentera des excuses pour cette \u00ab erreur \u00bb.    <\/span><\/p>\n<\/li>\n<li dir=\"ltr\">\n<p dir=\"ltr\"><span lang=\"FR\">Il     est pour le moins \u00e9trange que l\u2019OFPRA ait rejet\u00e9 sa demande d\u2019asile,     feignant d\u2019ignorer ses craintes en cas de retour en Tunisie. L\u2019OFPRA aurait     d\u00fb exclure monsieur Tebourski de sa demande pour s\u2019\u00eatre rendu coupable     d\u2019agissements contraire \u00e0\u00a0 la Convention de Gen\u00e8ve, en vertu d&rsquo;un article de     ladite Convention que l\u2019Office sait appliquer dans d\u2019autres cas. On est en     droit de se demander pour quelle raison officieuse l\u2019Office n\u2019a pas respect\u00e9     son propre r\u00e8glement. Et les r\u00e9percussions de ce rejet sont     incommensurables. En cas d\u2019exclusion de la Convention de Gen\u00e8ve, l\u2019OFPRA     aurait mentionn\u00e9 les risques encourus en Tunisie, et cette mention aurait     \u00e9t\u00e9 d\u00e9cisive devant le juge administratif. La d\u00e9cision de la CRR dat\u00e9e du 17     octobre 2006,-le recours devant cette instance n\u2019est pas suspensif du     renvoi- a \u00e9voqu\u00e9 l\u2019article pr\u00e9voyant les clauses d&rsquo;exclusion et     l\u2019organisation Human Rights Watch a tir\u00e9 de ce curieux chap\u00eetre la seule     conclusion qui s\u2019impose : \u00ab Cette d\u00e9cision, bien qu\u2019elle ait refus\u00e9 \u00e0     Tebourski le statut de r\u00e9fugi\u00e9, aurait n\u00e9anmoins requis que les autorit\u00e9s     fran\u00e7aises s\u2019abstiennent de l\u2019expulser vers la Tunisie en raison de     l\u2019interdiction absolue de renvoyer quelqu\u2019un dans un pays o\u00f9 cette personne     risque d\u2019\u00eatre soumise \u00e0 la torture. Si elle \u00e9tait tomb\u00e9e lors que Tebourski     se trouvait encore en France, le gouvernement fran\u00e7ais aurait d\u00fb soit     annuler l\u2019arr\u00eat\u00e9 d\u2019expulsion, soit ne pas l\u2019ex\u00e9cuter jusqu\u2019\u00e0 ce qu\u2019un pays     tiers dispos\u00e9 \u00e0 l\u2019accepter ait pu \u00eatre identifi\u00e9 \u00bb (8)<\/span> <\/p>\n<\/li>\n<li dir=\"ltr\">\n<p dir=\"ltr\"><span lang=\"FR\">Les     autorit\u00e9s fran\u00e7aises font fi des injonctions de l\u2019ONU et expulsent Adel     Tebourski alors que le Comit\u00e9 n\u2019a pas rendu sa d\u00e9cision. Le 11 mai 2007, le     Comit\u00e9 condamne la France pour non respect de l\u2019interdiction du renvoi des     personnes vers un pays o\u00f9 elles risquent la torture. La France passera outre     une autre fois : quelques semaines plus tard, le 2 juin 2007, les autorit\u00e9s     fran\u00e7aises renvoient un autre demandeur d\u2019asile, Houssine Tarkhani, qui sera     interpell\u00e9, tortur\u00e9 et incarc\u00e9r\u00e9 \u00e0 son arriv\u00e9e en Tunisie <\/span><\/p>\n<\/li>\n<li dir=\"ltr\">\n<p dir=\"ltr\"><span lang=\"FR\">La     premi\u00e8re fois qu\u2019Adel Tebourski a \u00e9t\u00e9 extrait du centre de r\u00e9tention pour     \u00eatre conduit au tribunal administratif (TA), il avait \u00e9t\u00e9 rev\u00eatu d\u2019un gilet     pare-balles et une atmosph\u00e8re pour le moins \u00e9lectrique avait baign\u00e9 les     travaux du tribunal d\u00fbe \u00e0 une mobilisation s\u00e9curitaire pl\u00e9thorique. On a     invoqu\u00e9 la protection de sa propre s\u00e9curit\u00e9, ce qui l\u2019a fait d\u2019abord rire,     puisqu\u2019il avait b\u00e9n\u00e9fici\u00e9 de permissions alors qu\u2019il \u00e9tait d\u00e9tenu et s\u2019\u00e9tait     promen\u00e9 en toute libert\u00e9 sur la voie publique, puis il a refus\u00e9 d\u2019assister     aux audiences du TA, pour que celui-ci puisse statuer sereinement. <\/span> <\/p>\n<\/li>\n<li dir=\"ltr\">\n<p dir=\"ltr\"><span lang=\"FR\">    Enfin, Ma\u00eetre Bo\u00e9zec a relev\u00e9 une autre anomalie ; il avait saisi la     Commission des Recours des R\u00e9fugi\u00e9s (CRR) \u00e0 un autre titre, en vertu de la     convention de Gen\u00e8ve sur les r\u00e9fugi\u00e9s, dans le but d\u2019interrompre la     proc\u00e9dure de renvoi, or le minist\u00e8re de l\u2019Int\u00e9rieur a consid\u00e9r\u00e9 que Adel     Tebourski n\u2019avait pas le statut de r\u00e9fugi\u00e9. Or, point n\u2019est besoin d\u2019avoir     le \u00ab statut de r\u00e9fugi\u00e9 \u00bb pour y pr\u00e9tendre : \u00ab Les normes minimales que     doivent remplir les ressortissants des pays tiers ou les apatrides pour     pouvoir pr\u00e9tendre au statut de r\u00e9fugi\u00e9 ou les personnes qui, pour d\u2019autres     raisons, ont besoin d\u2019une protection internationale, (&#8230;) Aux fins de la     pr\u00e9sente directive, on entend par a) (&#8230;) b (&#8230;) c) \u00ab r\u00e9fugi\u00e9 \u00bb, tout     ressortissant d\u2019un pays tiers qui, parce qu\u2019il craint avec raison d\u2019\u00eatre     pers\u00e9cut\u00e9 du fait de sa race de sa religion de sa nationalit\u00e9, de ses     opinions politiques ou de son appartenance \u00e0 un certain groupe social, se     trouve hors du pays dont il a la nationalit\u00e9, et qui ne peut ou du fait de     cette crainte ne veut se r\u00e9clamer de la protection de ce pays, ou tout     apatride qui, se trouvant pour les raisons susmentionn\u00e9es hors du pays dans     lequel il avait sa r\u00e9sidence habituelle, ne peut ou, du fait de cette     crainte ne veut y retourner et qui n\u2019entre pas dans le champ d\u2019application     de l\u2019article 12 ; d) \u00ab statut de r\u00e9fugi\u00e9 \u00bb (&#8230;) (9). Combien de temps ce r\u00e9pit   apparent durera-t-il ? Elles restaient difficiles \u00e0   interpr\u00e9ter au vu de la mentalit\u00e9 du R\u00e9gent de Tunis et de la nature du   syst\u00e8me dans lequel il a solidement enferr\u00e9 le peuple tunisien. La   reconnaissance du Forum d\u00e9mocratique pour le Travail et les libert\u00e9s (FDTL)   fait partie de ces gestes hautement calcul\u00e9s. On peut gager qu\u2019avant m\u00eame de   reconna\u00eetre officiellement la formation de Dr Mustapha Ben Ja\u00e2far, la police   politique avait d\u00e9j\u00e0 mis en piste son cheval de Troie. C\u2019\u00e9tait l\u2019obscur Ben   A\u00efcha, qui allait disputer au militant fondateur, y compris devant les   tribunaux,\u00a0 rien de moins que le leadership du parti et ses moyens mat\u00e9riels.   N\u2019e\u00fbt \u00e9t\u00e9 la personnalit\u00e9 de Dr. Ben Ja\u00e2far et le caract\u00e8re grossi\u00e8rement   voyant de la man\u0153uvre, le Forum aurait vu ses cl\u00e9s, ses locaux et ses moyens   financiers livr\u00e9s sur un plateau, avec ou sans d\u00e9cision de justice, \u00e0 l\u2019agent   infiltr\u00e9 que l\u2019on aurait ensuite bombard\u00e9 leader de l\u2019opposition. <\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">C\u2019est le sort qu\u2019a   connu l\u2019Association des Magistrats tunisiens (ATM) quand l\u2019agent Khaled Abb\u00e8s   a renvers\u00e9 la direction l\u00e9gitime de l\u2019Association men\u00e9e par le magistrat Ahmed   Rahmouni. C\u2019est \u00e9galement ainsi qu\u2019avait \u00e9t\u00e9 men\u00e9 le putsch de Isma\u00eel Boulahya   au MDS, en parfaite complicit\u00e9, sinon sous les ordres du minist\u00e8re de   l\u2019int\u00e9rieur. <\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">Les plaignants   contre la Ligue tunisienne des droits de l\u2019homme (LTDH) r\u00e9\u00e9diteront le m\u00eame   r\u00f4le, contribuant \u00e0 la paralysie de l\u2019organisation. Dans ce dernier cas, un   \u00e9levage de taupes avait \u00e9t\u00e9 introduit au sein de la Ligue des ann\u00e9es avant de   se manifester, \u00e0 la mani\u00e8re du VIH. <\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">Dans tous ces cas   cependant, les personnages ayant rempli la sale besogne sont des agents tr\u00e8s   mal camoufl\u00e9s de la tortiocratie. Ils sont dans leur r\u00f4le et ob\u00e9issent \u00e0 leur   donneur d\u2019ordre. <\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">Ce qui reste une   v\u00e9ritable plaie et un fait impossible \u00e0 comprendre, ce sont les rixes, bient\u00f4t   transform\u00e9es en gu\u00e9guerres fratricides, entre opposants que l\u2019on ne peut   raisonnablement soup\u00e7onner d\u2019accointances b\u00e9naliennes. <\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">On se rappelle   encore la sortie de Faouzi Ben M\u2019rad\u00a0 contre la direction l\u00e9gitime du tout   jeune RAID (ATTAC-Tunisie). La scission ainsi suscit\u00e9e avait cisaill\u00e9   l\u2019association naissante et alt\u00e9r\u00e9 son image tant \u00e0 l\u2019int\u00e9rieur qu\u2019\u00e0   l\u2019ext\u00e9rieur. Le m\u00eame Ben M\u2019rad jouera un r\u00f4le similaire \u00e0 l\u2019Association des   Jeunes avocats tunisiens (ATJA) contre Me Chawki Tabib. Les deux associations   s\u2019en sortiront certes, mais affaiblies. <\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">Au plan syndical   et politique, \u00e0 chaque apparition d\u2019une initiative de lutte nationale, on   touche du bois pour qu\u2019un g\u00e9nial illumin\u00e9 ne vienne pas casser un \u00e9difice si   laborieusement construit. On l\u2019a vu avec le grand Mouvement du 18-Octobre,   sauv\u00e9 du scepticisme plus ou moins innocent de certains par sa propre   dynamique, quoique notablement essouffl\u00e9 depuis. Osons esp\u00e9rer que son   anniversaire ce moi-ci constitue un point de relance\u2026<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">Il se trouvera   quand m\u00eame des membres plus ou moins bien intentionn\u00e9s au sein du Syndicat des   journalistes pour reprocher \u00e0 son pr\u00e9sident Lotfi Hajji, entre autres, d\u2019avoir   pris part au Mouvement. Le Syndicat en question n\u2019en est pas sorti grandi.  <\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">A ce propos, on ne   peut que d\u00e9plorer am\u00e8rement l\u2019isolement dans lequel s\u2019\u00e9tait retrouv\u00e9 Dr Moncef   Marzouki \u00e0 son retour en Tunisie l\u2019an dernier. D\u2019autant plus que cet isolement   n\u2019avait rien de fatal ni de spontan\u00e9\u2026<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">Le dernier et   inconcevable exemple est celui de l\u2019Association internationale de soutien aux   prisonniers politiques (AISPP), cette blessure b\u00e9ante au flanc du peule,   rel\u00e8ve du plus pur absurde kafka\u00efen.<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">Voici une   structure que son combat, ses r\u00e9ussites, son endurance et ses souffrances avec   les victimes et pour eux, avait \u00e9rig\u00e9e en institution reconnue et respect\u00e9e\u00a0.   Tout d\u2019un coup, elle est comme prise de folie, d\u2019une ivresse   d\u2019autodestruction. Les coups de sang se r\u00e9p\u00e8tent \u00e0 intervalle r\u00e9gulier en ce   mois de septembre 2007. Des clans se dessinent, men\u00e9s l\u2019un par le juge Mokhtar   Yahyaoui, l\u2019autre par le pr\u00e9sident sortant Me Mohamed Ennouri. <\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">Un langage de plus   en plus acerbe marque des \u00e9changes publics vindicatifs, puis haineux. La   bataille devient implacable et les parties campent sur leurs positions.   Jusqu\u2019au jour o\u00f9 le juge Yahyaoui annonce son retrait, le 19 septembre. On se   dit que l\u2019Association est sauv\u00e9e par le retrait d\u2019un des deux protagonistes.   Mais voil\u00e0 que Me Mohamed Ennouri annonce sa d\u00e9mission de mani\u00e8re fracassante,   en date du 20 septembre, soit le lendemain. Le m\u00eame jour, appara\u00eet un   communiqu\u00e9 sign\u00e9 collectivement annon\u00e7ant la cessation des communiqu\u00e9s sign\u00e9s   au nom de l\u2019association. Mais en m\u00eame temps, une prise de position claire en   faveur de l\u2019un des deux protagonistes du conflit. <\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">Bref, on n\u2019a   jamais vu pire Radeau tunisien de la M\u00e9duse. <\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">Nous insistons ici   \u00e0 dessein sur le sort de l\u2019AISPP. En effet, s\u2019il y a une seule association qui   aurait d\u00fb ne jamais conna\u00eetre la moindre tension interne, c\u2019est bien celle-l\u00e0.   Le respect et l\u2019affection dont jouissent Me Ennouri et l\u2019honorable juge   Yahyaoui font que les Tunisiens ressentent leur guerre fratricide comme une   catastrophe nationale. C\u2019est pour cette raison que nous avons esp\u00e9r\u00e9 que   l\u2019Association atteindrait la terre ferme \u00e0 la date fix\u00e9e pour l\u2019Assembl\u00e9e   g\u00e9n\u00e9rale, soit le 2 octobre 2007. Cela aurait \u00e9t\u00e9 l\u2019occasion pour les deux   grandes figures de la soci\u00e9t\u00e9 civile de faire cesser le conflit par un retrait   digne et sans fracas. Au moment o\u00f9 nous mettions sous presse, la police   faisait la chasse aux membres de l\u2019Association pour les emp\u00eacher de se r\u00e9unir.   Et comme si Ben Ali avait besoin d\u2019un coup de main\u2026<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"FR\">Faouzi Ben M\u2019rad,   Me Ennouri, M. Yahyaoui, les d\u00e9tracteurs de Lotfi Hajji ou ceux de l\u2019actuelle   direction l\u00e9gitime de la LTDH sont-ils conscients de leurs actes\u00a0? Se   doutent-ils du b\u00e9n\u00e9ficiaire final de leurs d\u00e9m\u00eal\u00e9s\u00a0? Despite   everything the government is doing, it is increasing and it became more   popular among students, good students,\u00a0\u00bb says Abdel Raouf al-Ayadi, a lawyer in   Tunis.<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">He says the   young men are growing more conservative and some are following the   fundamentalist Salafist ideology that some militant groups have also adopted.<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">\u00ab\u00a0Here the   government is thinking [militants] are doing [violent] things because they   don&rsquo;t have enough money to live. But the real reason is the occupation in   Iraq, Afghanistan, Palestine, Somalia. It&rsquo;s political, not economic at all,\u00a0\u00bb   says Mr. Ayadi.<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">Amr Hamzawy, a   senior associate at the Carnegie Endowment for International Peace who helped   author a report on Islamist movements in the Arab world, said the continued   lack of political space locked mainstream political Islamists in a   confrontational position with the government and \u00ab\u00a0you force elements of their   constituencies to consider other strategies,\u00a0\u00bb says Mr. Hamzawy.<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">Tunisia has   indeed solved what many of its Arab neighbors consider one of the region&rsquo;s   greatest threats: the challenge presented by political Islam. While Egypt and   Morocco accord opposition groups some space, however narrow or   government-controlled, Tunisia has banned all Islamic parties.<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">More than 20   years ago, Abdullah Zouari supported the Islamist political party an-Nahda,   which hoped to bring Islamic sharia law to Tunisia by winning elections.<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">\u00ab\u00a0Our ideas were   to talk about distributing the wealth of the country and,\u00a0\u00bb says Mr. Zouari,   pulling out a book on the fundamentalist an-Nahda, pointing to a page listing   their goals. The list includes transparency, modernizing Islam, and rebuilding   an Islamic identity and civilization in Tunisia and the world.<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">In 1989,   an-Nahda candidates made a strong showing in national elections. Soon after,   the group was blamed for clashes with security forces, sporadic violence   against government institutions, and plotting violent overthrow of the   government. The government arrested tens of thousands of people through 1992   on charges of belonging to an-Nahda or plotting attacks in Tunisia.<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">\u00ab\u00a0The regime   depicted an-Nahda as being this brutal, Islamist force of crazies in order to   get support of a pretty progressive middle class against it,\u00a0\u00bb says Clement   Henry, a professor of political science and political economy at the   University of Texas who says he has been banned from Tunisia for writing a   critical article of President Zine el-Abidine Ben Ali.<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">\u00ab\u00a0Many people   had joined an-Nahda as an alternative to the regime as it became increasingly   repressive,\u00a0\u00bb he said.<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">Tunisia&rsquo;s   approach to Islamists raises questions for governments and political Islam   that are echoed across the rest of North Africa. \u00ab\u00a0Is it able to endorse   secular regulations and rules of law? Is the secular leadership homogenous   enough and strong to resist to an Islamic uprising? Would it be an invitation   to danger or would it be a credible and reliable step toward a liberal system?   These questions are on the spot and in debate,\u00a0\u00bb wrote Hamadi Redissi,   University of Tunis political science professor, in an e-mailed response to   questions.<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">The emerging   group of young Islamists has indeed learned from their predecessors. Human rights groups said the trials were unfair. The six young   men in jail were freed in 2006.<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">\u00a0<\/span><\/p>\n<p dir=\"ltr\"> <span lang=\"EN-GB\">The government   says it still believes the men are dangerous and that terrorism is a lurking   threat, warranting its tactics, which many considered heavy-handed.
