La nouvelle loi modifie l&rsquo;Article 61a du code p\u00e9nal, qui impose \u00e0 l&rsquo;heure actuelle des peines allant de cinq \u00e0 douze ans de prison \u00e0 quiconque entre en contact avec des \u00ab\u00a0agents d&rsquo;une puissance \u00e9trang\u00e8re dans le but de miner la situation militaire ou diplomatique de la Tunisie.\u00a0\u00bb L&rsquo;amendement dispose que tout citoyen tunisien qui \u00e9tablit des \u00ab\u00a0contacts avec des agents d&rsquo;une puissance \u00e9trang\u00e8re ou avec une organisation \u00e9trang\u00e8re\u00a0\u00bb afin de nuire aux \u00ab\u00a0int\u00e9r\u00eats vitaux de la Tunisie\u00a0\u00bb et \u00e0 sa \u00ab\u00a0s\u00e9curit\u00e9 \u00e9conomique\u00a0\u00bb sera puni, selon ce qu&rsquo;a rapport\u00e9 mardi l&rsquo;agence officielle de nouvelles TAP.   Toutefois, les membres du TMG de l&rsquo;IFEX s&rsquo;inqui\u00e8tent du fait que cette loi, telle que r\u00e9dig\u00e9e, risque d&rsquo;\u00e9touffer les \u00e9ventuelles et l\u00e9gitimes protestations politiques et sociales. Toute restriction \u00e0 la libert\u00e9 d&rsquo;expression ne devrait pas \u00eatre r\u00e9dig\u00e9e en termes tr\u00e8s vagues et doit \u00eatre proportionnelle au but l\u00e9gitime poursuivi, \u00e0 savoir prot\u00e9ger la s\u00e9curit\u00e9 nationale.   Les groupes locaux et internationaux de d\u00e9fense des droits de la personne ont fait part de leur grave pr\u00e9occupation en mai, lorsque le Conseil des ministres dirig\u00e9 par le Pr\u00e9sident Zine El Abidine Ben Ali a annonc\u00e9 l&rsquo;avant-projet de loi. Cet avant-projet semblait avoir \u00e9t\u00e9 cr\u00e9\u00e9 en r\u00e9action aux appels lanc\u00e9s \u00e0 l&rsquo;Union europ\u00e9enne (UE) par les d\u00e9fenseurs tunisiens des droits de la personne pour qu&rsquo;on lie la promotion de la Tunisie au \u00ab\u00a0statut avanc\u00e9\u00a0\u00bb aupr\u00e8s de l&rsquo;UE \u00e0 l&rsquo;am\u00e9lioration de son bilan d\u00e9sastreux au chapitre des droits de la personne.   L&rsquo;Article 2 de l&rsquo;article d&rsquo;association de 1995 entre la Tunisie et l&rsquo;UE stipule que le respect des principes d\u00e9mocratiques et des droits fondamentaux guide les politiques int\u00e9rieures et internationales des deux parties.   \u00ab\u00a0Le parlement tunisien adopterait n&rsquo;importe quel projet de loi que lui pr\u00e9senterait le gouvernement, quels que soient les probl\u00e8mes que cela pourrait cr\u00e9er pour le pays et sa population. Le pouvoir l\u00e9gislatif est un outil qui sert les int\u00e9r\u00eats du Pr\u00e9sident et r\u00e9duit au silence ses critiques,\u00a0\u00bb dit Mokhtar Yahyaoui, ancien juge, constamment harcel\u00e9 depuis qu&rsquo;il a fait parvenir en 2001 une lettre au Pr\u00e9sident Ben Ali pour le prier de prot\u00e9ger l&rsquo;ind\u00e9pendance de la magistrature.   L&rsquo;adoption de la nouvelle l\u00e9gislation est survenue au milieu d&rsquo;une vaste campagne de d\u00e9nigrement dans les m\u00e9dias, orchestr\u00e9e par le gouvernement, \u00e0 l&rsquo;encontre des d\u00e9fenseurs des droits de la personne qui ont r\u00e9cemment rencontr\u00e9 des responsables de l&rsquo;Union europ\u00e9enne. Les d\u00e9fenseurs tunisiens des droits de la personne ont simplement demand\u00e9 \u00e0 leurs interlocuteurs europ\u00e9ens de rappeler \u00e0 leurs partenaires tunisiens la n\u00e9cessit\u00e9 urgente de respecter leurs obligations en mati\u00e8re de droits de la personne, en particulier le Pacte international relatif aux droits civils et politiques et l&rsquo;Accord d&rsquo;association avec l&rsquo;Union europ\u00e9enne.   \u00ab\u00a0Apr\u00e8s l&rsquo;adoption de cette loi honteuse, nous sommes de plus en plus pr\u00e9occup\u00e9s par l&rsquo;intensification de la guerre contre la libert\u00e9 d&rsquo;expression et la s\u00e9curit\u00e9 des d\u00e9fenseurs tunisiens des droits de la personne et des journalistes critiques,\u00a0\u00bb d\u00e9clare le pr\u00e9sident du TMG, Rohan Jayasekera, de Index on Censorship. \u00ab\u00a0Le temps est venu, pour les amis et les partenaires du gouvernement tunisien au sein de l&rsquo;Union europ\u00e9enne et au-del\u00e0, d&rsquo;interc\u00e9der pour faire cesser l&rsquo;utilisation des pouvoirs l\u00e9gislatif et judiciaire dans le but d&rsquo;\u00e9touffer la libert\u00e9 d&rsquo;expression et de punir les d\u00e9fenseurs de la d\u00e9mocratie.\u00a0\u00bb   Les membres du TMG de l&rsquo;IFEX ont lanc\u00e9 le 6 juin 2010 \u00e0 Beyrouth (Liban) un rapport sur les conclusions de la mission d&rsquo;enqu\u00eate qui s&rsquo;est rendue en Tunisie du 25 avril au 6 mai 2010. The new legislation amends Article 61a of the penal code, which currently imposes jail sentences from five to 12 years for contacting \u00ab\u00a0agents of a foreign power to undermine the military or diplomatic situation in Tunisia.\u00a0\u00bb The amendment stipulates that any Tunisian who establishes \u00ab\u00a0contacts with agents of a foreign power or a foreign organisation\u00a0\u00bb to harm \u00ab\u00a0Tunisia&rsquo;s vital interests\u00a0\u00bb and its \u00ab\u00a0economic security\u00a0\u00bb will be sanctioned, reported the official news agency TAP on Tuesday.   However, IFEX-TMG members are concerned that this law, as drafted, will stifle legitimate political and social protest. Any restrictions on freedom of expression should not be vaguely drafted and should be proportionate to the legitimate aim pursued \u2013 protecting national security.   Local and international human rights groups expressed their deep concern in May when the Tunisian cabinet headed by President Zine El Abidine Ben Ali announced the draft law. It appeared to be created in reaction to calls by Tunisian human rights defenders for the European Union (EU) to tie Tunisia&rsquo;s promotion to an \u00ab\u00a0advanced status\u00a0\u00bb with the EU to the improvement of its alarming human rights record.   Article 2 of the 1995 association agreement between Tunisia and the EU stipulates that respect for democratic principles and fundamental rights guide the two parties&rsquo; domestic and international policies.  \u00ab\u00a0The Tunisian parliament would pass any draft law presented by the government; whatever problems it would create for the country and the people. The legislative branch is a tool to serve the President&rsquo;s interests and silence his critics,\u00a0\u00bb said Mokhtar Yahyaoui, a former judge constantly harassed since he sent a letter in 2001 to President Ben Ali to urge him to protect the independence of the judiciary.   The adoption of the new legislation occurred amid a smear media campaign orchestrated by the government against vocal human rights defenders who recently met with European Union officials. The act amends Article 61 bis. of the Tunisian penal code, which already punishes \u00ab\u00a0anyone who has undertaken, by any means whatsoever, to undermine the integrity of the Tunisian territory or has met agents of a foreign power, the purpose or the result of which is to undermine the military or diplomatic situation of Tunisia.\u00a0\u00bb The new provision penalizes anyone who \u00ab\u00a0deliberately contacts foreign sides\u00a0\u00bb to harm Tunisia&rsquo;s vital interests, which were expanded to include economic interests, according to a report from Agence Tunis Afrique Press (TAP), Tunisia&rsquo;s official news agency.   \u00ab\u00a0It is believed that the law was created in direct response to the activities of a number of human rights defenders, who recently lobbied the European Union against granting &lsquo;advanced status&rsquo; to Tunisia unless it honours its national and international human rights commitments.\u00a0\u00bb   \u00ab\u00a0IPI is concerned that this law was created to punish journalists and human rights activists,\u00a0\u00bb said IPI Director David Dadge. \u00ab\u00a0If it is in Tunisia&rsquo;s national interest to improve its economic relations with Europe, then Tunisia should align its own policies with the human rights requirements in its Association Agreement with the EU. What it should not do is to accuse Tunisian citizens of treason simply because they want their government to uphold the standards to which it is committed.\u00a0\u00bb   \u00ab\u00a0This law is now a new sword of Damocles on the head of human rights defenders, free writers and journalists,\u00a0\u00bb said Sihem Bensedrine in an email to IPI. Bensedrine, who participated in a lobbying mission to the EU in May this year, heads Tunisia&rsquo;s independent Radio Kalima and is Secretary General of the Tunisian free press group OLPEC. \u00ab\u00a0Some officials have already called in their campaigns for the withdrawal of nationality and the imprisonment of some defenders, as &lsquo;criminals.'\u00a0\u00bb   Bensedrine said that while the law will not deter her or others from defending freedom in Tunisia or conducting advocacy campaigns, \u00ab\u00a0the price is now higher.\u00a0\u00bb   She added: \u00ab\u00a0Tunisia&rsquo;s partners and in particular the EU should react strongly.\u00a0\u00bb   IPI participated in a joint fact-finding mission to Tunisia earlier this year. President Ben Ali is expected to sign the bill after its anticipated approval by the Chamber of Councilors. The change is unconstitutional since it violates freedom of expression as guaranteed by Tunisian constitution, according to CPJ research.<\/span><\/p>\n<p align=\"justify\"><span>Under the bill, which amends Article 61a of the penal code, any Tunisian who establishes \u201ccontacts with agents of a foreign power or a foreign organization with a view to inciting them to harm the vital interests\u201d of Tunisia and its \u201ceconomic security\u201d will be sanctioned, the official news agency, TAP,<a target=\"_blank\" title=\"http:\/\/www.tap.info.tn\/en\/index.php?option=com_content&amp;task=view&amp;id=8872&amp;Itemid=99999999\" rel=\"noopener\"><span>reported<\/span><\/a> on Wednesday. Sanctions vary from five years in prison in times of peace to 12 years in times of war, lawyers told CPJ. <\/span><\/p>\n<p align=\"justify\"><span>\u201cWe are alarmed by the continued escalation of the war on free expression in Tunisia and are concerned about the well-being of our colleagues, who are among the prime targets for this restrictive bill,\u201d said Mohamed Abdel Dayem , CPJ program coordinator for the Middle East and North Africa . \u201cWe call on President Ben Ali, who has repeatedly demonstrated his control over all branches of government, to abide by international standards for freedom of expression and not sign<b> <\/b>this legislation into law.\u201d<\/span><\/p>\n<p align=\"justify\"><span>The bill was rapidly approved by the lower chamber of parliament, which is controlled by President Ben Ali\u2019s ruling Democratic Constitutional Rally, at a time when government critics are targeted by a state-backed smear campaign echoed by the state-run media, according to CPJ research. Journalists recently called on the European Union not to grant Tunisia \u201cadvanced [trading] status\u201d unless it takes concrete steps toward improving its human rights record, particularly with regard to silencing dissent. <\/span><\/p>\n<p align=\"justify\"><span>\u201cThis bill and its vague provisions would constitute a major threat to fundamental rights, particularly freedom of expression and opinion,\u201d Mokhtar Trifi, president of the Tunisian League for Human Rights, the first of its kind in the Arab world and among the most harassed NGOs in the country, told CPJ. \u201cIt\u2019s rather catastrophic to see Tunisians still denied the right to discuss any important issue.\u201d <\/span><\/p>\n<p align=\"justify\"><span>Attacks on independent journalists intensified in tenor and frequency immediately following the fifth-term reelection of Ben Ali in October 2009 with nearly 90 percent of the vote. Two critical journalists,<a target=\"_blank\" title=\"http:\/\/cpj.org\/2010\/02\/in-prison-tunisian-journalists-health-is-worsening.php\" rel=\"noopener\"><span>Taoufik Ben Brik<\/span><\/a> and<a target=\"_blank\" title=\"http:\/\/cpj.org\/2010\/01\/prison-term-completed-tunisian-still-behind-bars.php\" rel=\"noopener\"><span>Zouhair Makhlouf<\/span><\/a>, have been jailed for six and four months, respectively, for their work. Next week, an appeals court in the southern city of Gafsa will consider whether to uphold a<a target=\"_blank\" title=\"http:\/\/cpj.org\/2010\/01\/in-tunisia-a-journalist-is-sentenced-to-four-years.php\" rel=\"noopener\"><span>four-year jail term<\/span><\/a> handed to journalist Fahem Boukadous for covering social protests in 2008. Dans un communiqu\u00e9 transmis \u00e0 Xinhua jeudi soir, une source officielle au minist\u00e8re tunisien de la Justice et des Droits de l&rsquo;Homme a affirm\u00e9 que le projet de loi ne visait pas \u00e0 restreindre les libert\u00e9s et les d\u00e9fenseurs des droits de l&rsquo;Homme dans le pays.  \u00ab\u00a0La loi adopt\u00e9e par le Parlement, portant ajout d&rsquo;un paragraphe \u00e0 l&rsquo;article 61 Bis du Code p\u00e9nal, n&rsquo;a aucune relation avec la libert\u00e9 d&rsquo;expression et d&rsquo;opinion et n&rsquo;incrimine nullement la d\u00e9fense des droits de l&rsquo;Homme\u00a0\u00bb, a affirm\u00e9 la source officielle tunisienne.  Mardi, le Parlement tunisien a adopt\u00e9, au cours d&rsquo;une s\u00e9ance pl\u00e9ni\u00e8re, un projet de loi compl\u00e9tant les dispositions de l&rsquo;article 61 Bis du Code p\u00e9nal, qui s&rsquo;inscrit dans le cadre du renforcement des attributs de la s\u00e9curit\u00e9 \u00e9conomique et de la consolidation du dispositif l\u00e9gislatif garantissant la protection des acquis nationaux.  Toutefois, Amnesty international a estim\u00e9 jeudi matin que cette loi \u00ab\u00a0renforce les restrictions auxquels font face les militants des droits de l&rsquo;Homme, en visant ceux qui s&rsquo;expriment sur la situation tunisienne dans des instances internationales\u00a0\u00bb.  La source officielle tunisienne a tenu \u00e0 rappeler dans son communiqu\u00e9 que la loi en question concerne en effet l&rsquo;incrimination de tout entretien de contacts avec des agents d&rsquo;un Etat \u00e9tranger, d&rsquo;institutions \u00e9trang\u00e8res ou d&rsquo;organisations \u00e9trang\u00e8res dont le but de les inciter \u00e0 porter atteinte aux int\u00e9r\u00eats vitaux de la Tunisie relatifs \u00e0 sa s\u00e9curit\u00e9 \u00e9conomique.  Cependant, la m\u00eame source a indiqu\u00e9 que \u00ab\u00a0l&rsquo;expression de toute opinion engendrant m\u00eame pr\u00e9judice, n&rsquo;est pas incrimin\u00e9e en tant que telle, le fait incrimin\u00e9e concerne plut\u00f4t l&rsquo;\u00e9tablissement, uniquement par des Tunisiens, de contacts avec les parties \u00e9trang\u00e8res sus-indiqu\u00e9es et ce dans le but de porter atteinte aux int\u00e9r\u00eats vitaux de la Tunisie\u00a0\u00bb.  Elle a rappel\u00e9 dans ce contexte, qu&rsquo;en \u00e9dictant cette la loi, la Tunisie ne fait nullement l&rsquo;exception, maintes l\u00e9gislations \u00e9trang\u00e8res ayant \u00e9rig\u00e9 l&rsquo;atteinte aux int\u00e9r\u00eats vitaux de l&rsquo;Etat en infraction.
